O capital se produz, se realiza e se acumula pelo movimento contraditório do modo de produção capitalista, como relações sociais de produção historicamente determinadas. A forma social do capital tem sua forma mais elementar a forma-mercadoria. Dela se derivam todas as demais formas sociais - forma-valor, forma-dinheiro e forma sujeito de direito - enquanto formas sociais que tanto refletem o caráter social da atividade humana concreta, quanto determinam o modo pelo qual os indivíduos são produzidos historicamente. O capital, em sua totalidade social, se desenvolve por formas sociais dominantes em que se realiza o movimento real e contraditório de reprodução do capital. A articular seus atores sociais, produzidos socialmente como titulares de subjetividade jurídica, em relações jurídicas, de maneira antagônica. O capital, em última instância, consiste na valorização do valor. No movimento contraditório por suas formas sociais, o capital, sob a forma-dinheiro, se apresenta como o início, o fim e o meio, em última instância, de todo o plexo de relações sociais que se estruturam a partir da forma-mercadoria. A reprodução do capital se opera por contradições em movimento, cujo resultado, a valorização do valor sob a forma-dinheiro, implica por negar a sua própria essência, a força produtiva humana sob a forma de trabalho abstrato. Na dinâmica social contraditória do capital, a crise, então, é o motor das transformações sociais, determinadas, em ultima instância, pela disruptura da valorização do valor, por seu regime de acumulação, modo de produção e regulação internas ao período histórico. Tendo por base a leitura de Louis Althusser e a proposta de sistematização dos eixos das correntes do novo Marxismo que proposto por Alysson Mascaro, o chamado novo marxismo que se desenvolve a partir dos anos 1960, será analisada a teoria das formas sociais na leitura marxista, tendo por base a obra de maturidade de Marx, especialmente O Capital e o Grundrisse. Com vistas ao estudo da teoria da regulação e das crises do capital em suas implicações n o Estado e o direito, no desenvolvimento de contratendências à crise de valorização pela queda tendencial da taxa de lucro.

Capital is produced, realized and accumulated through the contradictory movement of the capitalist mode of production, as historically determined social relations of production. The social form of capital has its most elementary form, the commodity form. All other social forms derive from it - value-form, money-form and subject-of-law form - as social forms that both reflect the social character of concrete human activity and determine the way in which individuals are historically produced. Capital, in its social totality, develops through dominant social forms in which the real and contradictory movement of capital reproduction takes place. To articulate its social actors, socially produced as holders of legal subjectivity, in legal relations, in an antagonistic way. Capital, ultimately, consists of the appreciation of value. In the contradictory movement for its social forms, capital, in the form of money, presents itself as the beginning, the end and the middle, ultimately, of the entire plexus of social relations that are structured from the commodity-form. The reproduction of capital is operated by contradictions in motion, the result of which, the valorization of value in the form of money, implies denying its own essence, the human productive force in the form of abstract labor. In the contradictory social dynamics of capital, the crisis, then, is the engine of social transformations, determined, in the last instance, by the disruption of the valorization of value, by its accumulation regime, production mode and regulation internal to the historical period. Based on the reading of Louis Althusser and the proposal to systematize the axes of the currents of the new Marxism proposed by Alysson Mascaro, the so-called new Marxism that develops from the 1960s onwards, the theory of social forms in the Marxist reading will be analyzed, based on Marx's mature work, especially Capital and the Grundrisse. With a view to studying the theory of regulation and capital crises in their implications for the State and the law, in the development of counter-tendencies to the crisis of valuation due to the tendency to fall in the rate of profit.
