Este trabalho dedica-se ao exame de um tema que vem adquirindo centralidade, embora ainda pouco explorado na sociologia jurídica, qual seja: a governança global. O estudo desta instituição é feito sobre o pano de fundo da abordagem teórica de Anthony Giddens sobre a Teoria da Estruturação e a Modernidade Reflexiva. Serve-se também do aporte de autores da sociologia jurídica, tais como Niklas Luhmann e Boaventura de Sousa Santos. A partir do trabalho de Giddens sobre a globalização e a mudança de paradigma sofrida pelos Estados nacionais, busca-se analisar a mudança pela qual esse passou no que diz respeito ao seu papel de ator principal na regulação jurídica. Procura-se com enfoque especial na obra de André- Jean Arnaud realizar uma análise da passagem de uma forma de governo à forma da governança no processo de tomada de decisão complexa, a qual remete a uma nova ordem de produção jurídica que deve ser considerada diante do contexto de alta modernidade. Objetiva-se, portanto, apontar, com base nos autores selecionados, de que forma se dá a interação entre Direito e governança e como essa relação se encaixa no contexto da sociedade globalizada. Acrescenta-se como objetivo dessa pesquisa o desenvolvimento de considerações acerca da contribuição que a teoria sociológica de Giddens pode fornecer ao estudo do Direito com destaque às temáticas aqui analisadas.

This work is dedicated to the examination of a topic that has acquired centrality, although still little explored in juridical sociology, that is: global governance. The study of this institution is made against the background of the theoretical approach of Anthony Giddens on the Theory of Structuration and Reflexive Modernity. It is also supported by authors of juridical sociology, such as Niklas Luhmann and Boaventura de Sousa Santos. Based on Giddens' work on globalization and the paradigm shift suffered by the national states, the aim is to analyze the change that has taken place in relation to his role as the main actor in legal regulation. A special focus on André-Jean Arnaud's work is to analyze the transition from a form of government to the form of governance in the complex decision-making process, which refers to a new order of legal production that must be considered in the context of high modernity. It is therefore intended to point out, based on the selected authors, how the interaction between Law and governance is and how this relationship fits within the context of globalized society. The aim of this research is still the development of considerations about the contribution that the sociological theory of Giddens can give to the study of Law with emphasis on the themes analyzed here.
