Nas últimas décadas, verificou-se a emergência de técnicas regulatórias experimentais em diferentes jurisdições. Esses instrumentos questionam a forma tradicional da regulação jurídica, baseada na previsibilidade, estabilidade e segurança jurídica. Diante dos efeitos desse fenômeno sobre os padrões tradicionais de legitimação do direito e da regulação, indagou-se "quais são as vantagens e desvantagens da adoção de técnicas experimentais de regulação?", ou seja, quais são os efeitos da adoção dessa prática para os diferentes atores em jogo (agentes privados, reguladores, legisladores e sociedade civil)? Tais questões foram avaliadas no contexto da aplicação dessas técnicas à regulação de novas tecnologias. Esse exame se deu por meio da comparação das técnicas experimentais com outras formas de regulação, na tentativa de regular os efeitos de uma tecnologia emergente: as aeronaves pilotadas remotamente para dispersão de fertilizantes. Metodologicamente, promoveu-se a análise documental de relatórios e artigos acadêmicos sobre a regulação desse uso tecnológico no Brasil e na França. Com base nesse exame, essa dissertação delineou os fatores que devem ser levados em consideração por alguém que avalia a pertinência do emprego de técnicas experimentais: (i) deve-se ter consciência de qual incerteza pretende-se reduzir com seu emprego, qual desenho de pesquisa é o mais recomendável para produzir a informação visada e quais são as suas limitações metodológicas; (ii) o enquadramento de determinada discussão como um problema experimental tem dimensões políticas, de modo que faz-se necessária a ampla participação no processo de desenho e execução do estudo; (iii) em alguns casos, essas técnicas colidem com a igualdade jurídica, de tal forma que faz-se necessário justificar as clivagens feitas no tratamento jurídico-regulatório ante as promessas informacionais da técnica experimentar; (iv) os efeitos das técnicas experimentais para a previsibilidade do direito devem estar justificados na capacidade das técnicas regulatórias de promover a adaptação das normas às mudanças sociais.

In recent decades, experimental regulatory techniques have emerged in different jurisdictions. These instruments challenge the traditional form of legal regulation, based on predictability, stability, and legal certainty. In light of the effects of this phenomenon on the traditional patterns of legitimation of law and regulation, this Dissertation was guided by the following question: What are the advantages and disadvantages of adopting experimental regulatory techniques?, that is, what are the effects of adopting this practice for the different actors at play (private agents, regulators, legislators, and civil society)? These issues were evaluated in the context of the application of these techniques to the regulation of new technologies. This examination took place through the comparison of experimental techniques with other forms of regulation, in an attempt to regulate the effects of an emerging technology: remotely piloted aircrafts for fertilizer dispersion. Methodologically, a documental analysis of reports and academic articles on the regulation of this technological use in Brazil and France was promoted. Based on this examination, this Dissertation outlined the factors that must be taken into account by someone who evaluates the pertinence of the use of experimental techniques: (i) one must be aware of which uncertainty one intends to address with their use, which research design is the most recommendable to produce the targeted information, and what are its methodological limitations; (ii) framing a given discussion as an experimental problem has political dimensions, so broad participation in the study design and execution process is necessary; (iii) in some cases, these techniques collide with legal equality, in such a way that it is necessary to justify the cleavages made in the legal-regulatory treatment before the informational promises of the experiment technique; (iv) the effects of experimental techniques on the predictability of l, must be justified in the ability of regulatory techniques to promote the adaptation of norms to social changes.
