A presente pesquisa teve por objeto formular uma análise da perda parcial de sentido da experiência humana a partir do processo de secularização das instituições e do pensamento ocidentais, passando a sociedade a pautar-se por postulados da Ciência marcadamente racionalista. Para efeitos da pesquisa, esta parte negligenciada da vivência foi investigada em termos de misticismo e da religião. Buscou-se estabelecer as implicações dessa limitação nas esferas do Direito que se afastou de sua feição inicial, sacramental e voltada para o bom senso e passou a trabalhar como mero instrumento técnico de solução de conflitos concretos em sociedade. A partir desse ponto, procurou-se analisar, em contraposição, a ideia ocidental quanto a estas relações e as percepções de religião e direito para os judeus que constituíram uma sociedade eminentemente respeitosa em relação às regras religiosas que se confundem, pela tradição, com as normas de Direito. Analisou-se questões relativas à sacralidade da linguagem e às formas de interpretar a "Lei". Como base teórica, foram utilizados autores como Espinosa e, em especial, Gershom Scholem que revitalizou, em termos teóricos, a análise da mística do judaísmo (especificamente da Cabalá) a partir começo do século XX. Propôs-se, a partir das pesquisas, um aprofundamento da hermenêutica jurídica, a partir de postulados de interpretação das normas religiosas judaicas e desenvolveu-se uma visão alegórica que relaciona o direito estatal e o mito do Golem judaico. A final, atentou-se, fenomenologicamente, para a questão da História humana como processo de vivência constante e da esperança na estruturação social futura a ser transplantada para o Direito.

The present research has aimed to formulate an analysis of the partial loss of meaning of human experience from the process of secularization of western institutions and thought, passing the society to be guided by postulates of the Science markedly rationalist. For the purposes of the research, this neglected part of the experience has been investigated in terms of mysticism and religion. It has been sought to establish the implications of this limitation in the spheres of Law that had moved away from its initial feature, sacramental and common sense; and has begun to work as a mere technical instrument for solving concrete conflicts in society. From this point onwards, it has been sought to analyze the Western idea of these relations and the perceptions of religion and law for the Jews, who had constituted a society that has been eminently respectful of the religious rules that are traditionally confused with rules of Law. Questions regarding the sacredness of language and the ways of interpreting the "Law" have been analyzed. As a theoretical basis, authors such as Espinosa and, in particular, Gershom Scholem have been utilized, which revitalized, in theoretical terms, the analysis of the mystique of Judaism (specifically Kabbalah) from the beginning of the 20th century. It has been proposed, from the researches, a deepening of the juridical hermeneutics, starting from postulates of interpretation of the Jewish religious norms and an allegorical vision has been developed that relates the state law and the myth of the Jewish Golem. At the end, phenomenologically, it has looked at the question of human history as a process of constant living and hope in the future social structure to be transplanted to the law.
