Este trabalho se utiliza do método científico inaugurado na maturidade de Marx para investigar, no nível mais abstrato de análise, a forma-dinheiro e sua relação com as demais formas sociais capitalistas, especialmente a mercadoria, o direito e o Estado. Enquanto trabalho científico, seus principais objetivos são apresentar uma bibliografia que já relacione o dinheiro às demais formas sociais e avançar na elaboração mais precisa e coerente desta relação. Com isso, pretende trazer uma melhor compreensão do dinheiro para os debates marxistas notadamente jurídicos e políticos, ao mesmo tempo em que busca se valer dessa melhor apreensão do dinheiro para aperfeiçoar as compreensões atuais de direito e Estado. Para atingir tais objetivos, o trabalho parte do sistema conceitual de Marx, Pachukanis e do debate da derivação do Estado; prossegue com o levantamento de elementos teóricos acerca do dinheiro em diferentes círculos, desde os predecessores da nova leitura de Marx, com Rubin, até debates econômicos franceses, com Tran e Brunhoff; e, por fim, culmina em uma proposta de melhor articulação conceitual desses elementos teóricos sobre aquelas bases. Por essa sistematização reformulada, pode-se sustentar, fundamentalmente, que as mercadorias e os sujeitos de direito, sendo correlatos, constituem uma esfera privada, pois indiretamente social; enquanto o dinheiro e o Estado, também correlatos, constituem uma esfera pública, pois imediatamente social.

This paper employs the scientific method inaugurated in Marx's maturity to investigate, at the most abstract level of analysis, the money-form and its relationship with other capitalist social forms, especially the commodity, the law and the state. As a scientific work, its main objectives are to present a bibliography that already relates money to other social forms and to advance in a more precise and coherent elaboration of this relationship. In doing so, it intends to bring a better understanding of money to Marxist debates, notably legal and political ones, at the same time that it seeks to draw on this better apprehension of money to improve current understandings of law and the state. In order to achieve these objectives, the paper starts from the conceptual framework of Marx, Pashukanis and the state derivation debate; it proceeds with the collection of theoretical elements about money in different circles, from the predecessors of the new reading of Marx, with Rubin, to French economic debates, with Tran and Brunhoff; and, finally, it culminates in a proposal for a better conceptual articulation of these theoretical elements on those bases. Through this reformulated systematization, one can sustain, fundamentally, that commodities and legal subjects, being correlated, constitute a private sphere, since it is indirectly social; while money and the state, also correlated, constitute a public sphere, since it is immediately social.
