Esta tese de doutoramento tem como propósito fundamental discutir a relação entre direito e ressentimento a partir da filosofia nietzschiana. A conexão entre essas duas noções é pensada tomando-se por base o parágrafo 11 da segunda dissertação da obra Para a genealogia da moral, escrita por Nietzsche em 1887. Partindo de uma apreciação do lugar e da função do assim denominado "procedimento genealógico" no corpo da filosofia nietzschiana, pretende-se compreender como direito e ressentimento se relacionam no pensamento do autor a fim de demonstrar porque o direito poderia ser compreendido como uma "luta contra o ressentimento". Nesse sentido, para possibilitar o atingimento do objetivo aqui proposto, o presente trabalho está dividido em três etapas. Em um primeiro momento, realiza-se um exame do método genealógico como forma de se oferecer um suporte para a leitura e interpretação do texto da Genealogia. No segundo momento, passase à análise das duas primeiras dissertações de forma a se compreender o processo de formação do humano e do desenvolvimento da consciência moral e o aparecimento do fenômeno do ressentimento. De posse desse instrumental teórico, chega-se à etapa derradeira do trabalho, na qual se estuda detalhadamente o conteúdo do parágrafo mencionado tendo em vista o objetivo de promover uma crítica aos institutos e às instituições jurídicas pela chave da análise feita por Nietzsche do fenômeno do ressentimento.

This doctoral thesis has the fundamental purpose of discussing the relationship between law and ressentiment from the Nietzschean philosophy. The connection between these two notions is based on paragraph 11 from the second dissertation of Nietzsche's work On the genealogy of morals published in 1887. Starting from an appreciation of the place and function of the so-called "genealogical procedure" in the Nietzschean philosophy, it is intended to understand how law and ressentiment are related in the author's thought in order to demonstrate why law could be understood as a "struggle against ressentiment". In this sense, in order to achieve the objective here proposed, the present work is divided into three stages. At first, an examination of the genealogical method is made as a way to offer a support for the reading and interpretation of the Genealogy's text. In the second moment, we proceed to the analysis of the first two dissertations in order to understand the process of mankind formation and the development of moral consciousness along with the appearance of the phenomenon of ressentiment. Possessing this theoretical instrument, we arrive at the last stage of the work, in which the content of the mentioned paragraph is studied in detail with the aim to promote a critique of institutes and legal institutions through Nietzsche's analysis of the phenomenon of ressentiment.
