O presente trabalho adota o referencial da teoria dos sistemas de autores como Niklas Luhmann com a finalidade de responder ao seguinte problema de pesquisa: a crise de intervenção política e jurídica nas diversas esferas da vida social, e especialmente na área da moradia, conduz a uma substituição da lógica da cidadania e dos direitos sociais pela lógica do mercado e do consumo como caminho de inclusão social? Para tanto, realizou-se um estudo de caso sobre o Sistema Financeiro da Habitação (SFH) brasileiro, em razão das múltiplas nuances associadas à ideia de inclusão/exclusão social e à relação entre direito e economia que ele permite observar. Adotamos uma abordagem de inspiração sociolinguística para alargar o potencial empírico da teoria dos sistemas e reconstruir criticamente os discursos produzidos em torno do financiamento habitacional na sociedade moderna. Com isso, foi possível identificar e redescrever as tensões entre direito e economia a partir da análise da literatura e dos documentos associados ao financiamento habitacional, bem como do conteúdo de entrevistas semiestruturadas. A partir do referencial teórico sistêmico e da realidade brasileira, as operações de financiamento habitacional foram descritas como relacionadas primariamente à função do sistema da economia e à atividade dos bancos, apesar dos muitos contatos que mantêm com os sistemas da política e do direito. Em seguida, abordamos a dimensão mundial do SFH enfatizando os reflexos dos movimentos de globalização da economia e do direito (e suas tensões) nos discursos produzidos por posições sociais como as organizações políticoeconômicas globais e as organizações político-jurídicas globais. Após isso, retornamos à realidade brasileira com o objetivo de identificar as tensões entre direito e economia em discursos no âmbito nacional, notadamente por meio da observação de posições sociais como as organizações político-econômicas locais e as organizações político-jurídicas locais. Nesse caminho, o trabalho conclui que, no âmbito do SFH, há uma aproximação entre a lógica da efetivação da cidadania e dos direitos sociais, típica de um Estado de Bem-Estar, e a lógica do fortalecimento do mercado e do consumo, característica do Estado Neoliberal. As tensões entre essas duas lógicas ditam o tom das tentativas de inclusão social focadas no acesso à moradia no Brasil.

This work adopts the systems theory's theoretical framework of authors such as Niklas Luhmann in order to answer the following question: does the political and legal interventions' crisis in different spheres of social life, and especially in the housing area, lead to the replacement of the citizenship and social rights' logic by the market and consumption logic as a way of social inclusion? I developed a case study regarding the Brazilian Housing Finance System (SFH) because of the many nuances associated with the idea of social inclusion/exclusion and the relation between law and economy it is possible to observe in that area. It was adopted a sociolinguistic-inspired approach in order to enlarge the empirical potential of the systems theory and to critically reconstruct the discourses about the housing finance in the modern society. Thus, I identified and described the tensions between law and economy by conducting a literature review, a documentary analysis as well as some semi-structured interviews. As a result, based on the systems theory and the Brazilian reality, the housing finance's operations were described as primarily related to the economic system's social function and to the banks activities, despite the many contacts they maintain with the political and legal systems. Then, I approached the world dimension of the SFH and observed the reflexes of economic and legal globalization movements (and their tensions) on the discourses produced by social positions such as global political-economic organizations and global political-legal organizations. Afterward, I returned to the Brazilian reality in order to identify the tensions between law and economy in the national level's discourses, mainly through the observation of social positions such as local political-economic organizations and local political-legal organizations. In this way, the work concludes that, in the SFH area, there is a convergence between the logic of citizenship and social rights' concretization, which is typical of the Welfare State, and the logic of market and consumption's growth, which is representative of the Neoliberal State. The tensions between these two logics dictate the tone of social inclusion's attempts focused on the housing access in Brazil.
