Este trabalho apresenta um método de se integrar a análise das consequências ao processo de interpretação jurídica, notadamente envolvendo decisões judicias. O debate entre consequencialismo e deontologia, na filosofia moral, possui semelhanças com o debate entre realismo jurídico e formalismo jurídico. Mas, no campo do direito, as teorias consequencialistas existentes, entre outros problemas, não lidam adequadamente com vieses cognitivos e heurísticas. Com isso, sustenta-se que a análise econômica do direito e a teoria dos jogos fornecem instrumentos mais adequados para se analisarem as consequências no momento da tomada de decisões judiciais, bem como oferecem soluções a problemas para os quais o formalismo jurídico, base da formação jurídica tradicional no Brasil, não possui respostas. Este trabalho também inclui uma análise crítica do Direito e Economia, com a demonstração de suas limitações. Porém, sustenta-se que a análise econômica do direito é compatível com o direito penal brasileiro, uma área típica de comportamento fora de mercado.

This work presents a method of integrating the assessment of consequences within the process of legal interpretation, notably involving judicial opinions. The debate between consequentialism and deontology in moral philosophy has similarities with the debate between legal realism and legal formalism. But, in the law field, current consequentialist theories, among other problems, do not deal adequately with cognitive biases and heuristics. Therefore, I argue that economic analysis of law and game theory provide more adequate instruments to assess consequences in judicial decision-making, as well as they offer solutions to problems that legal formalism, which is the basis of traditional legal education in Brazil, does not present answers. This work also includes a critical analysis of Law & Economics, showing its limitations. However, I argue that economic analysis of law is compatible with Brazilian criminal law, a typical area of nonmarket behavior.
