O tema da presente dissertação é a representação do patrimonialismo na ordem jurídica brasileira, vislumbrada na perspectiva da obra "O Bem-Amado", de Dias Gomes. Partindo de uma visão interdisciplinar (do conhecimento humano), aliada ao pensamento complexo de Edgar Morin, e assumindo o caráter comunicativo do Direito, baseado na teoria de Tércio Sampaio Ferraz Jr., que vincula ao sistema jurídico a questão do poder e das estruturas de dominação, estuda-se o conceito de patrimonialismo de Max Weber, expondo sua tipologia de dominação e apresentando a forma como foi incorporada no Brasil. Tendo em vista que o patrimonialismo é um conceito imbuído de historicidade, propõe-se, com fundamento na teoria da história dos conceitos de Reinhart Koselleck, a construção de uma história nacional deste conceito, adequado à história social brasileira, a partir dos escritos de Raymundo Faoro, Simon Schwartzman e Maria Sylvia de Carvalho Franco, autores nacionais que inovaram em relação à concepção weberiana. Essa construção histórica é projetada na ficção de Dias Gomes, a fim de identificar o viés patrimonial na narrativa, seus elementos de interação com o sistema jurídico e suas conexões com o sistema coronelista, a violência social, a pobreza municipal, a crise de representatividade política e o autoritarismo de Estado.

The theme of this dissertation is the representation of patrimonialism in the brazilian legal order, seen from the perspective of the work "O Bem-Amado", by Dias Gomes. Starting from an interdisciplinary view (of human knowledge), allied to the complex thinking of Edgar Morin, and assuming the communicative character of law, based on the theory of Tércio Sampaio Ferraz Jr., which links to the legal system the question of power and structures of domination, the research study Max Weber's concept of patrimonialism, exposing his typology of domination and presenting the way it was incorporated in Brazil. Considering that patrimonialism is a concept imbued with historicity, it is proposed, based on the theory of the history of concepts by Reinhart Koselleck, the construction of a national history of this concept, appropriate to brazilian social history, from the writings of Raymundo Faoro, Simon Schwartzman and Maria Sylvia de Carvalho Franco, national authors who innovated in relation to the weberian conception. This historical construction is projected in the fiction of Dias Gomes, in order to identify the patrimonial bias in the narrative, its elements of interaction with the legal system and its connections with the coronelist system, social violence, municipal poverty, crisis of political representation and state authoritarianism.
