A partir de Marx e, em especial, das elaborações de Evgeny Pachukanis sobre o direito, esta dissertação analisa a relação intrínseca do direito e do Estado com o modo de produção capitalista e, particularmente, com a mercadoria. Inicia com uma demonstração sintética sobre o funcionamento do sistema capitalista e as contradições internas que levam a constantes crises econômicas e a condições de vida cada vez piores para a classe trabalhadora. Verifica como se articulam diferentes formas de acumulação e regulação que garantem a continuidade do sistema e apresenta as categorias de análise necessárias à compreensão de como o capitalismo, apesar das crises recorrentes, maneja e mantém a sua sociabilidade exploratória, em particular no contexto atual da financeirização. Em seguida demonstra o papel do Estado na garantia dos interesses do capital, seu caráter intrinsecamente capitalista e repressor, seja através dos mecanismos de coerção direta, seja através dos aparelhos ideológicos a ele atrelados. Finalmente analisa os desafios colocados no processo de construção de um Estado de transição e o papel do direito, através de uma visão crítica da experiência da ex-URSS.

Based on Marx and especially on Evgeny Pachukanis as a theoritical reference, this dissertation analyzes the intrinsic relation of Law and State to the capitalist mode of production and, particularly, to the commodity. It begins demonstrating briefly how capitalist system works and the internal contradictions that lead to constant economic crises and increasingly worse living conditions for the working class. It is verified how different forms of accumulation and regulation are articulated to ensure the continuity of the system. The categories of analysis necessary to understand how capitalism, despite its recurrent crises, manages to keep its exploratory sociability, especially in the context of financialization, are presented. It is then demonstrated the role of State in keeping the interests of capital, its intrinsically capitalist and repressive character, functioning either through the mechanisms of direct coercion or through the ideological devices attached to it. It is analyzed, in particular, the intrinsic relation of Law with capitalism and particularly with the commodity. Finally, challenges faced in the process of building a transitional State and the role of Law are analyzed, through a critical view of the experience of the former USSR.
