Partindo da premissa metacomplementar da legitimidade enquanto pressuposto socialmente difundido de obediência às normas provenientes de determinada autoridade, analisamos a legitimidade do sistema jurídico brasileiro a partir dos filmes O Caso dos Irmãos Naves (1967), Justiça (2004) e Juízo (2007). Para tanto, utilizamos o método interdisciplinar. Observamos a construção deste pressuposto de obediência através do procedimento judicial, no qual o Estado busca mostrar-se o mais neutro possível, escondendo a natureza claramente política das decisões judiciais. Em nossa análise, destacou-se a natureza constitutiva (em contradição à declaratória) da decisão judicial, inclusive no que tange às premissas fáticas. Concluímos pela impossibilidade do direito acessar diretamente os fatos passados, objetos de análise do processo, e observamos a necessidade de o Direito dissimular tais inseguranças para não sofrer em legitimidade. Analisamos a violência por parte do Estado, inclusa a questão da tortura, e seus efeitos para com a legitimidade. Por fim, observamos as formas de a autoridade estatal lidar com o indivíduo potencialmente perigoso para a autoridade institucional e abordamos brevemente a questão do crescimento das facções criminosas nos presídios brasileiros.

Starting from the metacomplementar premise of legitimacy as a socially widespread presupposition of obedience to the standards from a particular authority, we analyze the Brazilian law system's legitimacy from the films O Caso dos Irmãos Naves (1967), Justiça (2004) and Juízo (2007). For this, the interdisciplinary method was utilized. We observe the construction of this obedience assumption through the judicial procedure, in which the State seeks to show itself as natural as possible, hiding the clearly political nature of the judicial decisions. In our analysis, it was highlighted the constitutive nature (in contradiction to the declaratory) of the judicial decision, including the factual premises. Our conclusion was that impossibility of law to access past facts directly, which are the objects of lawsuits analysis, and the necessity of law to dissimulate such insecurities so it does not suffer in its legitimacy. We analyze the violence of the State, including the torture subject, and its effects on legitimacy. Lastly, we observe the ways of the State authority to deal with the potentially dangerous individual, and we briefly address the issue of the growth of the criminal factions in Brazilian prisons.
