Essa dissertação estuda os elementos constitutivos da racionalidade cínica - no direito, na psicanálise, na sociologia e na história - como fundamento para uma nova crítica do direito. Parte-se da hipótese de que, especialmente após o advento da pós-modernidade, o cinismo é um padrão de racionalidade que influencia as relações sociais e os atos jurídicos, que passam a admitir como legítimas decisões cujas normas, valores e princípios que lhe são subjacentes sejam usados para justificar decisões de conteúdo oposto aos axiomas, envernizando situação de violação, impermeabilizando situações sociais e jurídicas injustas e, com isso, fortalecendo o encastelamento das formas jurídicas que, a pretexto de elevarem valores e princípios de caráter emancipador, sofisticam as instituições técnico-positivistas e revitalizam os mecanismos de dominação.

This dissertation studies the constitutive elements of cynic rationality - in law, psychoanalysis, sociology and history - as the foundation for a new critique of law. The assumption is that, notably in the postmodern era, cynicism is a pattern of rationality that influences social relations and legal acts. Therefore, these acts come to accept as legitimate decisions whose underlying norms, values and principles are used to justify decisions of opposite content to axioms, varnishing a situation of violation of rights and social inequity, and thereby strengthening the entanglement of legal forms that, on the pretext of elevating juridical norms, sophisticate the techno-positivist institutions and revitalize the mechanisms of social domination.
