A presente pesquisa tem como principal escopo realizar uma investigação sobre as principais contribuições fornecidas por Giorgio Agamben para os temas da ética, da política e do direito, pensando-as, no entanto, a partir do pressuposto da justiça. Nesse sentido, ela busca realizar uma exegese filosófica do pensamento do autor, considerada em toda a sua multifariedade e completude, mas matendo o foco, no entanto, sobretudo nas obras pertencentes ao conjunto do projeto Homo sacer, uma vez que nosso objeto consiste principalmente no direito. Nesse sentido, na primeira parte do trabalho reconstruímos as principais teses e temas tratados pelo autor na construção de seu arcabouço filosófico, movimento que denominamos de As origens do programa da filosofia que vem, a qual consiste numa crítica radical da ontologia ocidental. Em seguida, no próximo capítulo, chamado Uma arqueologia do poder, entra-se na esfera do projeto Homo sacer propriamente dito, caso em que são investigadas as relações entre biopolítica, soberania e a proposta agambeniana do sujeito ético enquanto testemunho. No terceiro e último, O direito que vem, procurou-se investigar, por sua vez, os temas do estado de exceção, do governo e da justiça, mas, neste caso, o capítulo foi dividido em dois itens: no primeiro, foi analisada a mudança conceitual operada na ontologia do ocidente por meio do paradigma da efetualidade e as consequências que daí se impõem, enquanto que, na segunda, nos concentramos nas relações entre o direito e a justiça, concluindo, então, como, caso queiramos nos aproximar da justiça, a tarefa a ser cumprida será a de renunciar ao direito, pois ela não consiste numa substância ou propriedade, mas, segundo Agamben, na esteira de Walter Benjamin, num estado inapropriável do mundo.

The main scope of this research is to conduct an investigation into the main contributions provided by Giorgio Agamben to the themes of ethics, politics and law, considering them, however, through the catrgory of justice. In this sense, it seeks to carry out a philosophical exegesis of the author's thought, considered in all its multifariousness and completeness, but keeping focus, however, above all on the works belonging to the whole of the Homo sacer project, since our object consists, above all, on the theme of the law. In this sense, in the first part of the work, we reconstruct the main theses and themes dealt with by the author in the construction of his philosophical framework, a movement we call The origins of the program of the coming philosophy, which consists of a radical critique of Western ontology. Then, in the next chapter, called An archeology of power, we enter the sphere of the Homo sacer project itself, case in which the relations between biopolitics, sovereignty and the Agambenian proposal of the ethical subject as testimony are investigated. In the third and last chapter, The coming law, an attempt was made to investigate, in turn, the themes of the state of exception, government and justice, but, in this case, the chapter was divided into two items: in the first, the conceptual change operated in Western ontology was analyzed through the paradigm of actuality and the consequences that are imposed from it, while, in the second, we focus mainly on the relations between law and justice, concluding, then, how, if we want to, in any case, approach justice, the task to be fulfilled will then be to renounce the law, as it does not consist of any substance or property, but, according to Agamben, in the wake of Walter Benjamins definition, as an state of the world in which it cannot be appropriated.
