Este trabalho tem o objetivo de discutir o papel cumprido pelo conceito de "sujeito de direito" naquilo que Marx denominou a sua "crítica da economia política" e que expôs em forma definitiva em O capital. Para tanto toma-se uma definição desta "crítica" não como uma teoria econômica, mas como problemática geral que concebe o capitalismo como uma realidade social integral, vivida pelos indivíduos como experiência universal-natural, na qual estão completamente imersos e que lhes molda todas as esferas de experiência e de atividade, linguagem, desejo. Tal definição encontra lastro numa leitura da primeira seção do livro I de O capital que enfatiza o papel do conceito de "forma do valor" e da teoria do fetichismo da mercadoria como constituintes de uma esfera social de ação e representação imaginária, que é ao mesmo tempo objetiva e subjetiva. Em seguida, procede-se a uma análise das funções do conceito de "sujeito de direito" na composição dessa problemática. Com especial atenção ao modo como tal categoria emerge lógica/historicamente no/segundo o texto, aponta-se para a existência virtual em O capital de um "duplo caráter da subjetividade jurídica", correlato, como o termo sugere, ao duplo caráter da mercadoria e ao duplo caráter do trabalho. Isso permite expor o papel da categoria "sujeito de direito" na articulação entre a dimensão objetiva e a dimensão subjetiva da reprodução social, evidenciando a partir de sua dupla forma de aparecimento - como sujeito abstrato e como sujeito concreto - sua posição constitutiva na elaboração tanto de uma teoria da ação quanto de uma teoria da representação marxistas.

This thesis aims to discuss the role fulfilled by the concept of "subject of law" in Marx's "critique of political economy", exposed in Capital. For this purpose a definition of this "critique" is not taken as an economic theory, but as a general problematic that conceives capitalism as an integral social reality, experienced by individuals as a universal-natural experience, in which they are completely immersed and that shapes each sphere of the experience, activity, language, desire. Such a definition finds strength in a reading of the first section of Book I of Capital which emphasizes the role of the concept of "value form" and the theory of commodity fetishism as constituents of a social sphere of imaginary action and representation, which is simultaneously objective and subjective. Next, an analysis is made of the functions of the concept of "subject of law" in the composition of this problematic. With special attention to the way in which this category emerges logically/ historically in/according to the text, we point to the virtual existence in Capital of a "dual character of juridical subjectivity", correlated, as the term suggests, to dual character of commodity and the double character of labour. This allows us to expose the role of the category of "subject of law" in the articulation between the objective dimension and the subjective dimension of social reproduction, evidencing from its dual form of appearance - as abstract subject and as concrete subject - its constitutive position in the elaboration both of a theory of action as well as a theory of representation.
