A presente tese versa sobre a defesa de um instituto jurídico compreendido sob novos contornos: o direito de ser lembrado. Para tanto, após o estudo dos fundamentos do recentemente tão debatido direito ao esquecimento, se propõe traçar novos parâmetros para a interpretação dos direitos que têm na lembrança o seu enfoque de estudo. Com esse fim, se faz essencial a análise de três temas que dão base de sustentação para essa ideia: o reconhecimento, a memória e os direitos da personalidade. O reconhecimento interpretado como luta interpessoal, de caráter ético-relacional e não como simples desejo individualista. A memória, por sua vez, compreendida como o acervo dos conteúdos que moldam a identidade individual e, por fim, os direitos da personalidade abrigando tais temáticas dentro do universo jurídico, ancorado, sobremaneira, no princípio do livre desenvolvimento da personalidade. Evidencia-se, como resultado do estudo, que a adequada construção desse novo direito só se torna possível com o entendimento da noção de narrativa. O direito de ser lembrado abriga, assim, em seu conceito, uma ideia de tutela da identidade a partir de um viés contextual e temporal. Mostra-se adequado aplicar esse novo direito como resposta a algumas das mais recentes discussões do Direito Civil: a herança digital, a família unipessoal, os direitos da personalidade no post mortem e como uma reinterpretação do direito ao esquecimento, agora apreendido como espécie desse direito de ser lembrado, pois se o objetivo é esquecer, apagar algo, na verdade, o que se está pleiteando é ser lembrado sob determinado recorte narrativo.

This thesis defends and proposes new contours to the right to be remembered. It starts by dissecting the legal and historical foundations of the right to be forgotten to propose innovative parameters that may clarify legal categories primarily focused on the concept of memory. The thesis analysis three main legal fundaments of the right to be remembered: recognition, memory and rights of the personality. Recognition is interpreted as an ethicalrelational interpersonal struggle, and not simply as an individualistic desire. Memory, in it is turn, is understood as a catalogue that shape individual identity. At last, the rights of the personality as harbor of such themes within the legal cosmos, anchored, greatly in the principal of the free development of the personality. The research concludes that the adequate construction of this new right the right to be remembered is better justified through by exploring the legal-philosophical idea of narrative. The thesis proposes that the right to be remembered encompasses the crucial idea of protecting identity through a both temporal and contextual perspective. It is demonstrated that this new right offers a solution to some of the most daunting debates of contemporary Civil Law, such as digital inheritance, single person families, personality rights of the deceased, and, above all, as a reinterpretation of the right to be forgotten, which is now understood as a subspecies of the right to be remembered. This conclusion is based on the observation that if plaintiffs objective is to have their memories forgotten, deleted or erased, what is really at stake is the right of being remembered through a more favorable narrative framework.
