O presente trabalho busca analisar como duas diferentes correntes do direito oferecem respostas à dualidade entre direito e moral. De um lado, teorias positivistas propugnam a tese da separação, de outro as teorias jusnaturalistas propõem a vinculação entre direito e moral. Para realizarmos nossa análise, adotaremos como enfoque teórico a ideia de que a principal divergência entre essas correntes se resume, basicamente, em um debate sobre a validade do direito e quais os melhores parâmetros para essa avaliação, se deve ou não ser incluído um critério moral. Adotaremos como paradigma para essa análise o debate travado entre H.L.A. Hart e Lon Fuller. Para tanto, analisaremos cuidadosamente a obra desses autores expondo e contrapondo seus argumentos e buscaremos identificar a reposta mais adequada para esses critérios. Ao final, proporemos a análise de algumas situações concretas de modo a verificar a adequação de cada uma dessas teorias.

This work seeks to analyze how two different currents of law offer answers to the duality between law and morality. On one hand, positivism advocate the separation thesis, on the other, the natural law proposes a connection between law and morality. To perform such analysis, we will adopt as a theoretical focus the idea that the main divergence between these currents involves a debate about the validity of the law and what are the best parameters for this assessment, whether or not a moral criterion should be included. We will adopt as a paradigm for this analysis the debate between H.L.A. Hart and Lon Fuller. Therefore, we will carefully analyze the work of these authors, exposing and opposing their arguments and seeking to identify the most appropriate answer to these criteria. At the end, we will propose the examination of some concrete situations in order to verify the adequacy of each one of these theories.
