O presente estudo tem o intuito de realizar um estudo acerca das visões de mundo sobre indígenas que circulam entre os ministros do Superior Tribunal de Justiça (STJ) brasileiro. Para tanto, buscamos compreender como estes vêm julgando o que é o índio integrado do inciso III, art. 4.º, da Lei 6.001/1973 (Estatuto do Índio). É feita uma investigação empírica qualitativa das decisões desse Tribunal no período de 2004 a 2017 por meio de análise de conteúdo e antropologia interpretativa. Com este trabalho, objetiva-se fornecer embasamento para uma avaliação a respeito de visões que o Judiciário manifesta sobre os povos indígenas, suas identidades e seus direitos.

This masters dissertation aims to study the world visions about indigenous people that are carried by ministers of the Brazilian Superior Court of Justice. To do that, we attempt to comprehend how the Brazilian Superior Court of Justice have been judging who is an integrated Indian as disposed at article 4, III, of the Federal Law 6.001/1973 (Statute of Indians). To do that, an empirical qualitative analysis of the decisions between 2004 and 2017 of this court is done with the help of content analysis and interpretative anthropology. Our objective with this research is to provide elements for an evaluation of the images that the judiciary mobilizes of the indigenous peoples, their identities and their rights.
