O trabalho discute a moralidade da autonomia no interior do pensa- mento jurídico moderno através de duas tradições filosóficas abrangen- tes: o kantismo e o individualismo. Além de examinar um conjunto de entendimentos teóricos, o texto sugere que a doutrina do direito privado se abstenha de empregar o conceito de autonomia enquanto sua referên- cia permanecer injustificada ou se mantiver assimilada a noções menos exigentes de liberdade. Pretende-se, por fim, apresentar um caminho jurídico para a realização da moralidade da autonomia no Brasil.

The dissertation reviews the morality of autonomy within modern legal thought through two pervasive philosophical traditions: Kantism and Individualism. It surveys a set of theoretical propositions and suggests that private law doctrine shall refrain from using the concept of auton- omy in cases where its reference remains unjustified or absorbed by less demanding ideas of freedom. In the end, it purports to provide a legal path for the realization of the morality of autonomy in Brazil.
