Sobre a construção teórica da relação entre Direito e poder, tal como formulada por Miguel Reale, esta pesquisa, no intuito de preservar a lógica e originalidade do projeto filosófico realeano, superporá o método estrutural de leitura, a fim de apurar o movimento intencional de seu espírito analítico, a partir de um resgate nuclear da compreensão dos aspectos definidores da personalidade e da aplicação de sua filosofia. Em sequência, diante da seleção do esquema realeano da nomogênese jurídica, que ilustra o ponto inicial da sintaxe entre Direito e poder, esta pesquisa discorrerá sobre as características individuais dos elementos integrantes da experiência jurídica, e também sobre as suas interconexas relações, no âmbito do fundamento, eficácia e vigência da tensional dialética de implicação e polaridade existente entre valor, fato e norma. Por fim, esta pesquisa analisará minuciosamente o momento de interferência do poder nesse processo, descrevendo as suas configurações e requisitos, segundo as diversas contribuições realeanas, para com isso propor, conjeturalmente, a utilidade de uma reflexão amplificadora desse esquema nomogenético do Direito, includente da dinâmica funcional dos fatores componentes do núcleo constituinte do poder juridicizante, que propicia a transcendência da experiência do ser para a do dever ser.

On the theoretical construct of the relationship between law and power, as formulated by Miguel Reale, this research, aiming to preserve the logic and originality of his philosophical project, will apply the structural method of reading in order to find the movement of his intentional analytical spirit by retrieving the nuclear undestanding of the defining aspects of his philosophys personality. In sequence, selecting Miguel Reales nomogenetic scheme of juristic experience, that illustrates the beginning of the syntax between law and power, this research will discuss the individual characteristics of its elements, and comment about their interconnected relationships within the foundation, efficacy and validity of the dialectical tension existent between value, fact and norm. Eventually, this research will analyze the moment of power interference in the initial process of juristic experience, describing the settings of its profile and requirements, according to several contributions from Miguel Reale. Then, it will propose by conjecture a reflection that amplifies his nomogenetic scheme, including the vital dynamics of the constituent factors that make the juristic power, providing the transcendence of the experience of being to ought-to-being.
