Esta dissertação se volta ao estudo do processo judicial a partir da perspectiva pragmática, centrando sua análise sobre o poder e a argumentação com referência à metodologia interdisciplinar. Poder é entendido como interação, que se constitui discursivamente para controle, se afastando de uma concepção substantiva apropriável. A argumentação é o mecanismo linguístico pelo qual esse poder se constitui no âmbito processual, sendo suas bases clássicas fundamentais para o sucesso de seus objetivos de persuasão. Na confluência desses dois elementos (poder e argumentação), surge a efetivação legítima dos comandos judiciais, que no manejo de regras e princípios, garantem a segurança jurídica do ordenamento e a estabilidade do sistema. Essas reflexões serão tão mais valiosas quão mais forem confrontadas com perspectivas outras que não apenas a jurídico-normativa, de tal modo que a confrontação interdisciplinar é figura central no desenvolvimento da teoria. A aplicação, portanto, num caso prático, e principalmente na peça teatral Medida por Medida (do autor William Shakespeare) darão concretude e criticidade a esses termos teóricos, mostrando como o estudo jurídico se faz cada vez mais pertinente aos estudos sensíveis da realidade e das artes

This dissertation is a study of the judicial process from a pragmatic perspective, focusing its analysis on power and argumentation with regard to the interdisciplinary methodology. Power here is here understood as interaction, which is discursively constituted aiming control, moving away from an appropriative and substantive conception of it. Argumentation is the linguistic mechanism by which this power is constituted in the procedural realm, being its classic bases fundamental for the success of its persuasion objectives. At the confluence of these two elements (power and argumentation) arises the legitimate implementation of judicial commands, which in the management of rules and principles, ensures the legal certainty and the stability of the legal system. These reflections will be all the more valuable when confronted with perspectives that extend beyond normative ones, making interdisciplinary confrontation is a central figure in the development of this theory. The application, therefore, in a practical case, and especially in the play Measure for Measure (by author William Shakespeare) will give concreteness and criticism to these theoretical terms, showing how the legal study becomes increasingly pertinent to the sensitive studies of reality and art
