A pesquisa consiste na análise interdisciplinar entre um tema da Filosofia do Direito e uma obra literária. A obra em questão é Vidas Secas, de Graciliano Ramos, um romance da década de 1930 que, dentre as tensões que merecem atenção, estabelece uma em específico, através da qual são apresentados parâmetros para a compreensão da sociedade brasileira da época, com todas as contradições pertinentes do período histórico que motivaram a escrita do romance. A literatura se encontra com a Filosofia do Direito na medida em que as teorias críticas de Althusser e Pachukanis (Ideologia e Aparelhos Ideológicos de Estado e A Teoria Geral do Direito e o Marxismo, respectivamente) desenham abordagens sobre o Direito e sobre o Estado que estão representadas em Vidas Secas. Em Pachukanis, lê-se a forma como o discurso jurídico cria seu próprio mito fundador e desenvolve o modelo de subjetivação através do qual os seres humanos se constituem sujeitos de direito na modernidade. A contribuição althusseriana indica as formas de manutenção das máximas discursivas que forjam personalidades - jurídicas e físicas - no pleno momento da forma política estatal. Os discursos do trabalhismo, dos binômios indústria x agricultura, moderno x arcaico, urbano x rural, presentes em Vidas Secas, revelam as tensões através das quais Estado e Direito conseguem forjar uma sociedade brasileira capitalista de reposição do subdesenvolvimento em prol do regime de acumulação e dos consagrados privilégios elitistas em detrimento das vidas - secas - dos explorados. Neste sentido, a pesquisa tem como objetivo, através do aporte teórico marxista, fazer a leitura do romance da década de 30 como crítica ao modelo jurídico, ou mais, como crítica às formas política e estatal nas quais se desenvolve o mundo jurídico contemporâneo.

The research consists in the interdisciplinary analysis between a theme of the Philosophy of Law and a literary work. The work in question is Vidas Secas, by Graciliano Ramos, a novel from the 1930s that, among the tensions that deserve attention, establishes one in specific, through which parameters for the understanding of the Brazilian society of the time are presented, with all pertinent contradictions of the historical period that motivated the writing of the novel. Literature meets the Philosophy of Law insofar as the critical theories of Althusser and Pachukanis (Ideology and Ideological State Apparatuses and General Theory of Law and Marxism, respectively) make approaches on the Law and on the State that are represented in Vidas Secas, as a form of confirmation and precision of analysis by both Graciliano Ramos and Pachukanis and Althusser. In Pachukanis, one reads how the legal discourse creates its own founding myth and develops the model of subjectivation through which human beings are constituted subjects of law in modernity. The Althusserian contribution indicates the forms of maintenance of the discursive maxims that found personalities in the full moment of the state political form. The discourses of labor, of the industrial x agriculture, modern x archaic, urban x rural binomial, present in Vidas Secas, reveal the mosaic through which State and Law manage to forge a Brazilian capitalist society to replace underdevelopment in favor of the regime of accumulation and of the consecrated elitist privileges to the detriment of the lives of the exploited ones. In this sense, the research aims to make the reading of the novel of the 1930s as a critique of the legal model, or more, as a critique of the political and state forms in which the contemporary legal world develops.
