Campanhas políticas são fenômenos imbricados na relação entre representação eleitoral e mídia que comportam múltiplas abordagens jurídicas. Em democracias representativas, cada uma dessas abordagens é constituída por diferentes valores e estruturas jurídicas, projetadas para produzirem efeitos sociais e políticos. Esta tese se dedica a discutir como a regulação da comunicação de campanhas políticas no Brasil é desafiada com a emergência da internet. Nesse sentido, organiza um diagnóstico que visa responder (i) como a internet transforma a prática de campanhas políticas, modificando o contexto social, político e técnico que envolve a sua regulação; e, ainda, (ii) como essas transformações interagem com as premissas normativas, as estruturas jurídicas, e os efeitos almejados pelas diferentes abordagens que compõem essa regulação no Brasil? Assim, após passar por uma descrição da trajetória de transformações na representação eleitoral e na comunicação política, em face da emergência de campanhas intermediadas pela internet, o trabalho concentra-se em fazer uma reconstrução crítica do marco regulatório brasileiro, mapeando seus principais instrumentos e os conflitos neles inscritos.

Political campaigns are processes embedded in the relationship between electoral representation and the media and may support multiple legal approaches. In representative democracies, each approach is built upon different values and legal structures, designed to produce social and political effects. This thesis aims to discuss how the regulation of the communication of political campaigns in Brazil is challenged by the emergence of the internet. In this sense, it is aimed to answer (i) how the internet transforms the practice of political campaigns, modifying the social, political and technical context that involves its regulation; and (ii) how do these transformations interact with normative premises, legal structures, and the effects sought by the different approaches that make up this regulation in Brazil? Thus, after a description of the transformations in electoral representation and political communication, in the face of the emergence of internet-mediated campaigns, the research makes a critical reconstruction of its Brazilian regulatory framework, mapping its main instruments and the conflicts within them.
