Essa dissertação aborda, sob um aspecto jurídico-filosófico, a teoria das posições normativas de Kanger e Lindahl, construída com ferramentas de lógica deôntica e lógica de ação a partir das posições jurídicas elementares originalmente propostas por Hohfeld. São apresentadas as oito posições elementares de Hohfeld, analisando-se-as segundo a distinção de normas primárias e normas secundárias de Hart. São apresentados os oito tipos simples de direito e, enquanto conjuntos de maxi-conjunções, os vinte e seis tipos atômicos de Kanger, assim como os desenvolvimentos posteriores propostos por Lindahl e Sergot. As posições normativas são abordadas a partir da abstração permitida pela análise das posições normativas segundo as noções de maxi-conjunção, partição, assim como de elaboração e refinamento de uma partição, tal como no trabalhos de Makinson e Sergot. Discute-se, ainda como pode ser entendido o esforço de encontrar-se posições normativas efetivamente elementares a partir das noções de granularidade e completude.

This dissertation approaches, under a legal-philosophical aspect, the theory of normative positions of Kanger and Lindahl built with tools of deontic logic and logic of agency from the fundamental legal relations originally proposed by Hohfeld. Hohfeld's eight elementary conceptions are presented and analyzed accordingly to Hart's distinction between primary and secondary rules. The eight simple types of rights and, as sets of maxi-conjunctions, the twenty-six atomic types of Kanger are presented, as well as the later developments proposed by Lindahl and Sergot. The normative positions are approached from the abstraction allowed by the analysis of normative positions according to the notions of maxi-conjunction, partition, as well as the elaboration and refinement of a partition, as in Makinson and Sergot works. It is also discussed how the effort to find effectively fundamental normative positions based on the notions of granularity and completeness can be understood.
