O presente trabalho busca definir qual o estatuto teórico que os Atos Institucionais tiveram na ditadura civil-militar, no período entre 1964 e 1967. Por meio da recuperação de precedentes históricos, nas transições constitucionais, identificamos algumas características dos Atos Institucionais. Além disso, buscar-se-á indicar que os Atos Institucionais foram o produto intelectual de uma aliança histórica entre a cúpula das Forças Armadas e uma parcela importante dos juristas no Brasil. Dessa aliança, será evidenciada a influência do pensamento militar na confecção dos textos normativos dos Atos Institucionais, bem como a internalização da doutrina da guerra revolucionária e da Segurança Nacional no ordenamento jurídico nacional. Por fim, será analisado como essa forma jurídica repercute no regime político brasileiro no período.

The present work aims to define the theoretical statute of the 'Institutional Acts' had during the civil-military dictatorship between 1964 and 1967. Through an historical recovery of the Institutional Acts precedents in Brazilian history, we identified some of its features. Beside that, this work aims to present the alliance between the military elite and the civil elites, mainly the jurists, and to point out the influence in the juridical thought by the military doctrines. As a result, the Institutional Acts texts and the legal order had internalized the doctrine of revolutionary war and the doctrine of National Security. Finally, considerations will be made.on how theses doctrines affected Brazil's legal order and political regime.
