Esta dissertação, tem como objetivo trazer para a área da filosofia do direito as contribuições teóricas do renomado crítico cultural estadunidense Fredric Jameson. Identificaremos e correlacionaremos a tradição crítica do direito, para quem nos é cara a leitura jurídica de Marx feita por Evgeny Pachukanis, com as proposições teóricas de Jameson. Assim, temos como objetivo, além de compreender como se fundam as bases da teoria jamesoniana, notadamente seus conceitos de "hermenêutica", "pós-modernidade", "ideologia", "mapeamento cognitivo", "globalização" e "utopia", como formas de compreensão da reprodução social e dos meios de produção para a acumulação do capital, bem como da atuação do direito como instrumento ideológico e de repressão, mas também entender como estes podem se relacionar com a crítica ao direito e produzir uma estratégia política em busca da transformação social.

This dissertation aims to bring to the area of the philosophy of law the theoretical contributions of the renowned American cultural critic Fredric Jameson. We will identify and correlate the critical tradition of law, which in our studies is fundamental to the reading of Marx by Evgeny Pachukanis, with Jameson's theoretical propositions. Thus, in addition to understanding how the bases of the Jamesian theory are founded, notably its concepts of "hermeneutics", "postmodernity", "ideology", "cognitive mapping", "globalization" and "utopia", as ways of understanding social reproduction and the means of production for capital accumulation, as well as the act of law as an ideological and repressive instrument, but also to understand how this concepts can be related to the critique of law and produce a political strategy in seek of social transformation.
