O presente trabalho aborda o padrão de concretização da política de proteção social no Brasil sob o marco da Constituição Federal de 1988. Recupera antecedentes históricos, aborda seus traços normativos e a forma concreta que assumiu no processo de implementação. Considera atores, contexto e processos, na análise dos conflitos ensejados pela tramitação da Proposta de Emenda Constitucional 241/55/2016 e pela judicialização da Emenda Constitucional 95/2016 e do respectivo impacto sobre o sistema de seguridade social. Identifica, nesse processo, as estratégias que orientam as ações dos atores nas diferentes arenas e observa a dinâmica de competição desigual por recursos instaurada pelo Novo Regime Fiscal.

The present work addresses the pattern of implementation of the social protection policy in Brazil under the framework of the 1988 Federal Constitution. It seeks to recover the historical background, as well as its normative traits and the concrete form it took in the implementation process. It considers actors, context, and processes, in the analysis of the conflicts arising from the processing of the Proposal for Constitutional Amendment 241/55/2016 and the judicialization of the Constitutional Amendment 95/2016 and the corresponding impact on the social security system. It identifies, in this process, the strategies guiding the actions of actors in the different arenas and observes the dynamics of unequal competition for resources established by the New Fiscal Regime.
