Esta dissertação é fruto de uma pesquisa científica interdisciplinar, levada a efeito a partir da análise da interação dos campos do direito e da ciência, tecnologia e inovação. O estudo faz a abordagem das formas de regulação que podem ser qualificáveis como jurídicas, pois o fenômeno da produção de CT&I não se limita a uma ou outra cultura estanque, e assim, a pretensão de regulação destas práticas exclusivamente pelo direito positivo, caracteriza uma visão etnocêntrica, típica da sociedade ocidental na modernidade. Por outro lado, a incerteza, o risco e a velocidade da evolução científica e econômica, que formam a estrutura lógica do campo de CT&I, por vezes, se contrapõem à lógica do campo do direito, sobretudo pela pretensão do direito positivo de manter expectativas normativas no tempo. A pesquisa utilizou como referência as linhas teóricas do modelo desenvolvido pelo sociólogo e antropólogo Pierre Bourdieu - o enfoque estrutural construtivista - com o objetivo de identificar como as forças do campo de CT&I atuam no campo do direito, principalmente na formação daquilo que Bourdieu denominou de habitus.

This dissertation is the result of an interdisciplinary scientific research, developed by an interactive analysis of the law and science, technology and innovation fields. The study approaches the regulation kinds that can be qualified as legal, because the phenomenon of STI production is not limited to one or another closed culture, and thus, the regulation of these practices exclusively by positive law, characterizes an ethnocentric point of view, coming from modern Western society. On the other hand, the uncertainty, the risk and the rapid flow of scientific and economic evolution, that form the logical structure, which makes up the STI field, sometimes contradicts the logic of the law field, mainly because of the function of positive law, in the sense of maintaining long-term normative expectations. The research used as reference the theoretical premises that scientific model developed by the reputed sociologist and anthropologist Pierre Bourdieu - the constructivist structural approach -, in order to identify how the forces inside the STI field reverberate in the law field agents, especially in the formation of what Bourdieu conceptualized as habitus.
