Pretende-se, nesta pesquisa, realizar um estudo de caso sobre o coletivo Anonymous e sua atuação no ambiente digital. Propõe-se, inicialmente, uma reconstrução teórica acerca da relação existente entre movimentos sociais, Internet e Direito, utilizando-se da perspectiva da Sociedade em Rede, desenvolvida pelo sociólogo Manuel Castells. A síntese da pesquisa teórica servirá, em um segundo momento, como base metodológica para a organização e a interpretação de dados empíricos extraídos do estudo do coletivo Anonymous e de suas operações no ciberespaço. O argumento central desta tese consiste na proposição teórica de que o ciberativismo representa uma nova espécie de manifestação social, que faz uso de suas redes de comunicação on-line para mobilizar ações multidimensionais e maximizar sua eficácia, ampliando seu alcance espacial em menor dimensão temporal. Pressupõe-se que Direito e movimentos sociais estão constantemente relacionados e, geralmente, contrapostos, como expressões de poder e de contrapoder. As normas e as leis refletem as metas e os interesses do poder, enquanto os movimentos sociais exercem o contrapoder, propondo novas instruções e novos códigos a fim de reprogramar as redes de poder. O objetivo desta tese, então, é investigar as formas de atuação e de organização de movimentos sociais em rede, verificando como e com que finalidade esse tipo especial de movimento utiliza-se das tecnologias de informação e de comunicação para promover suas ações e, ainda, como essa nova espécie de movimento relaciona-se com o Direito. A contribuição original desta pesquisa reside na análise sociojurídica do movimento Anonymous, partindo da perspectiva da teoria da Sociedade em Rede. Os resultados deste estudo indicam que o Anonymous se mobilizou diante de propostas de regulação da Internet, sendo que, no Brasil, o coletivo questionou elementos do Marco Civil da Internet - notadamente seu modelo de retenção de dados de usuários, tipificado nos artigos 13 e 15 da Lei n.º 12.965/2014. No entendimento de algumas células do coletivo, o modelo adotado revela o caráter de vigilantismo do Estado, incompatível com o contexto de liberdade de expressão que seria inerente ao ciberespaço.

This research intends to carry out a case study about the Anonymous collective and its performance in the digital environment. Initially, it was proposed a theoretical reconstruction of the relationship between social movements, the Internet, and Law, using the Network Society perspective developed by sociologist Manuel Castells. Later, the synthesis of theoretical research will serve as a methodological basis for the organization and interpretation of empirical data extracted from the study of the Anonymous collective and its operations in cyberspace. The central argument of this thesis consists of the theoretical proposition that cyberactivism represents a new kind of social manifestation, which uses its online communication networks to mobilize multidimensional actions and maximize its effectiveness, expanding its spatial reach in a smaller temporal dimension. It is assumed that Law and social movements are constantly related and generally opposed as expressions of power and counter-power. Regulations and laws reflect the goals and interests of power, while social movements exercise counterpower, proposing new instructions and new codes in order to reprogram power networks. The aim of this thesis is to investigate the forms of action and organization of social movements in a network, verifying how and for what purpose this special type of movement uses information and communication technologies to promote its actions, and how this new kind of movement is related to Law. The original contribution of this research resides in the socio-legal analysis of the Anonymous movement from the perspective of the Network Society theory. The results of this study indicate that Anonymous mobilized in the face of proposals to regulate the digital environment. In Brazil, it questioned elements of the Bill of Rights for the Brazilian Internet, notably its data retention model typified in articles 13 and 15 of Law no. 12.965/2014. In the understanding of some cells of the collective, the model adopted reveals the vigilantism character of the State, which is incompatible with the context of freedom of expression that would be inherent to cyberspace.
