O trabalho teve por objetivo analisar se o atual sistema de responsabilidade civil dos provedores de aplicacao é justo e se os dados pessoais estao protegidos conforme legislacao especifica. A análise comecou com a descricao do conceito de técnica e sua transformacao conceitual na Modernidade. Verificou-se que há processos contundentes de desumanizacao individual e coletiva. Em seguida, passou-se a descrever e analisar como a tecnologia-base da Era Digital opera pelos fluxos de informacao da internet. Socialmente, verificamos os efeitos da linguagem construida pela tecnologia e suas fronteiras (IP internet protocol). Por fim, expôs-se a conceituacao de direitos humanos e suas dimensões. A partir disso fez-se a compactualizacao entre o Direito & Tecnologia. Verificou-se novos direitos. E, por meio do estudo de um caso prático, identificou-se que o sistema atual de responsabilidade civil nao condiz com os efeitos sociais da era digital. Concluiu-se que se trata de um sistema que deve ser complementado por meio da propria técnica, mas recolocando-a como meio e nao fim.

This work analyzed if the actual liability framework of the Applications on the internet is fair and if the personal data is protected according to the new legislation. The first step towards this objective was to describe the philosophical meaning of techné and how it has shifted into a new form on the modern society. This transformation carried out side effects of dehumanization and they were pointed out. The second step was to understand how does this technique of the digital era work. We have discussed how is the internet is operated and, as well, the side social effects of this new society of the digital era. The mainly idea is based on the language of the IP (internet protocol) that is creating a new form of communication within the internet technology. The third movement was to confront the technological progress with a judicial precedent. It is a Brazilian constitutional question about the liability of the internet platforms, it deals with individual rights such as free speech and right to privacy. The conclusion was to complement the actual liability Brazilian framework of the platforms on the internet with a more balanced and technical form of dispute resolution.
