A presente pesquisa tem por objeto analisar a importação do art. 10 do Código de Processo Civil de 2015 para o processo do trabalho. Pretende demonstrar que a norma processual civilista não pode ser aplicada ao processo laboral sem uma avaliação cuidadosa de sua passagem pelo filtro de compatibilidade estatuído pelo art. 769 da Consolidação das Leis do Trabalho. Veicula a ideia de que a norma civilista só pode incidir no processo trabalhista se concorde com a estrutura principiológica deste. Para tanto, estuda os direitos fundamentais ao contraditório e à efetividade do processo, partindo do seu resgate histórico e examinando, em seguida, o conteúdo das referidas garantias processuais. Estabelece as dimensões do princípio do contraditório (bilateralidade de oitiva, paridade de armas e direito de influência e de não surpresa) e a relação entre o contraditório e a cooperação. Trata da ligação entre a efetividade, a instrumentalidade e a razoável duração do processo. Cuida do fenômeno das decisões-surpresa, definindo o seu conceito e fazendo apontamentos sobre a matéria no direito comparado. Aborda os contornos da vedação às decisões-surpresa no direito positivo brasileiro, com a indicação de seu conteúdo, e examina algumas questões controvertidas relacionadas ao tema. Identifica as particularidades do litígio individual trabalhista e apresenta os fundamentos do processo individual do trabalho. Indica as bases sobre as quais está assentado o processo laboral e retrata o seu conteúdo e principais implicações. Evidencia que os direitos fundamentais costumam colidir, o que também ocorre entre com os direitos fundamentais de natureza processual, como o contraditório e a efetividade do processo. Coloca as premissas teóricas sobre a teoria dos princípios e os critérios para a solução das colisões de direitos fundamentais à luz do princípio da proporcionalidade. Examina o problema da importação do art. 10 do Código de Processo Civil de 2015 ao processo do trabalho a partir da colisão entre o contraditório e a efetividade do processo e desenvolve a referida interação por meio do princípio da proporcionalidade.

The present research aims to analyze the import of the article 10 of the Civil Procedure Code of 2015 for the labor procedure. It intends to demonstrate that the civil procedural rule can not be applied to the labor procedure without a careful evaluation of its passage through the compatibility filter established by the art. 769 of the Labor Rules Consolidation. It conveys the idea that the civil rule can only affect the labor procedure if it agrees with its principiological structure. In order to do so, it studies the fundamental rights to the adversary and the procedural effectiveness, starting from its historical recovery and then examining the content of these procedural guarantees. It establishes the dimensions of the adversarial principle (bilaterality of hearings, parity of arms and right to influence and to be not surprised) and the relationship between the adversarial and the cooperation. It deals with the link between the procedural effectiveness, the instrumentality and the speedy trial. It analyzes the phenomenon of the surprise-decisions, defining its concept and making notes about the matter in comparative law. It approaches the surprise-decision prohibition contours in brazilian law, with the indication of its content, and examines some controversial issues related to the subject. It identifies the individual labor litigation particularities and presents the individual labor procedure fundamentals. It indicates the labor procedure basis and portrays its content and main implications. It shows that fundamental rights usually collide, which also occurs between fundamental procedural rights, such as the adversarial principle and the procedural effectiveness. It presents the theoretical premises about the principles theory and the criteria for the solution of the fundamental rights collisions in the light of the proportionality principle. Examines the problem of importing art. 10 of the Civil Procedure Code of 2015 to the labor procedure in the light of the collision between the adversarial principle and the procedural effectiveness and develops said interaction through the proportionality principle.
