O presente estudo tem por objeto a análise do direito ao trabalho para imigrantes indocumentados pela perspectiva da Organização Internacional do Trabalho. No cenário da globalização, com a intensificação da mobilidade humana, é notável a construção de relações laborais calcadas na lógica da precarização e da marginalização do trabalhador imigrante, sobressaindo-se os indocumentados por sua maior vulnerabilidade. A partir da análise dos objetivos estratégicos e da função institucional da OIT, o estudo objetiva investigar os mecanismos utilizados pela Organização para promover a efetiva proteção desses trabalhadores imigrantes, bem como verificar a presença de diálogo eficaz entre diferentes instâncias normativas, para, ao final, trazer à reflexão eventual insuficiência normativa da OIT, no tocante à proteção dessa parcela de imigrantes. Para tanto, tomando-se como ponto de partida o arcabouço normativo produzido na OIT, faz-se uma análise comparativa com o Sistema de Proteção dos Direitos Humanos no âmbito global da Organização das Nações Unidas e no âmbito regional interamericano da Organização dos Estados Americanos. O reconhecimento do direito ao trabalho como um direito humano universal, integrante do patamar do mínimo existencial, o reconhecimento do interesse difuso do direito ao desenvolvimento humano, alcançado pelo acesso ao direito ao trabalho e o reconhecimento de que a universalidade dos direitos humanos é fator limitante da soberania nacional, são questões que fortalecem o sistema internacional de proteção dos direitos humanos, ao qual a Organização Internacional do Trabalho deve estar alinhada e comprometida. Ao assumir seu papel proeminente e estratégico de defesa dos direitos, na seara laboral, dos trabalhadores migrantes, a OIT contribui para a amplificação da cadeia de proteção dos direitos humanos, avocando para si a responsabilidade genuína de oferecer um referencial de proteção do direito ao trabalho, a ser incorporado nos sistemas global e regional de proteção e promoção dos direitos humanos e internacionalizado nos ordenamentos jurídicos nacionais, ampliando, pois, a esfera de reconhecimento do direito. O objeto da pesquisa é de natureza teórica e a reflexão apresentada é subsidiada por dados empíricos secundários, extraídos de bibliografia especializada, além da análise da normativa internacional e nacional, referente à temática da migração indocumentada.

The objective of the present study is to analyze the right to work for undocumented immigrants from the perspective of the International Labor Organization. In the scenario of globalization, with the intensification of human mobility, the construction of labor relations based on the logic of precariousness and marginalization of the immigrant worker is notable, in which those who are undocumented stand out because of their greater vulnerability. Based on the analysis of the ILO's strategic objectives and institutional function, the study aims to investigate the mechanisms used by the Organization to promote the effective protection of these immigrant workers, as well as to verify the presence of an effective dialogue between different normative instances, in order to ultimately bring to light the eventual normative insufficiency of the ILO in protecting this portion of immigrants. To this end, having as a starting point the normative framework produced at the ILO, a comparative analysis is made with the Human Rights Protection System at the global level of the United Nations and at the regional inter-American level of the Organization of American States. The recognition of the right to work as a universal human right, as a part of the minimum level of existence, the recognition of the diffuse interest of the right to human development, achieved through access to the right to work, and the recognition that the universality of human rights is a limiting factor of national sovereignty, are issues that strengthen the international system of human rights protection, which the International Labor Organization must be aligned and committed to. By assuming its prominent and strategic role in defending the rights of migrant workers in the labour market, the ILO contributes to the amplification of the human rights protection chain, invoking for itself the genuine responsibility of offering a benchmark for the protection of the right to work, to be incorporated into global and regional systems for the protection and promotion of human rights and to be internationalized in national legal systems, thus expanding the sphere of recognition of the right. The research object is of a theoretical nature and the reflection presented is subsidized by secondary empirical data, extracted from specialized bibliography, in addition to the analysis of international and national norms, referring to the theme of undocumented migration.
