Sob a justificativa de que os altos índices de informalidade e desemprego no Brasil são provocados, em grande medida, pela suposta inadequação do modelo clássico de contratação empregatícia, introduziu-se no país, no ano de 2017, o regime de contratação intermitente. Porém, há dúvidas quanto à compatibilidade do novo contrato com a ordem jurídica constitucional e convencional consolidada no país, assim também quanto à sua eficácia para os fins a que se propõe. Fundado nessa percepção, o objetivo desta dissertação é identificar a pertinência dos obstáculos lançados sobre o novo modelo, o que se faz a partir de duas frentes: de um lado, examina-se a construção jurídica trabalhista brasileira empreendida ao longo do século XX, correlacionando essa evolução com o conceito de trabalho decente; de outro, aborda-se a introdução do contrato de trabalho intermitente na realidade jurídica do país, tanto do ponto de vista da maturação do processo legislativo correspondente, como das implicações jurídicas e sociais decorrentes da mudança. A partir dessas bases, às quais se soma o estudo de regimes análogos ao modelo intermitente brasileiro no direito comparado, identifica-se em que medida se concretiza a adequação do novo regime à realidade brasileira, e quais são os caminhos para que sua inserção não contrarie a lógica que sempre orientou o desenvolvimento do direito do trabalho brasileiro. A metodologia de pesquisa utilizada ampara-se em pesquisa bibliográfica, exame de dados estatísticos, análise jurisprudencial e documental, sempre com o objetivo de contribuir de alguma forma para o estudo de tão impactantes mudanças na ordem jurídica nacional.

Under the justification that the high rates of informality and unemployment in Brazil are caused, to a large extent, by the supposed inadequacy of the classic model of employment contracting, in the year 2017, the regime of intermittent hiring was introduced in the country. However, there are doubts about the compatibility of the new contract with the constitutional and conventional legal order consolidated in the country, as well as about its effectiveness for the purposes for which it is proposed. Based on this perception, the objective of this dissertation is to identify the pertinence of the obstacles thrown on the new model, which is done from two fronts: on the one hand, the Brazilian labor legal construction undertaken throughout the 20th century is examined, correlating this evolution with the concept of decent work; on the other, it addresses the introduction of the intermittent employment contract in the country's legal reality, both from the point of view of the maturation of the corresponding legislative process, as well as the legal and social implications resulting from the change. From these bases, to which is added the study of regimes analogous to the Brazilian intermittent model in comparative law, it is identified to what extent the adequacy of the new regime to the Brazilian reality is realized, and what are the paths so that its insertion does not contradict the logic that has always guided the development of Brazilian labor law. The research methodology used is based on bibliographic research, examination of statistical data, jurisprudential and documentary analysis, always with the objective of contributing in some way to the study of such impactful changes in the national legal order.
