Esta pesquisa se dedica a analisar o instituto da autocomposição extrajudicial dos conflitos individuais trabalhistas, conforme a previsão trazida pela Lei n. 13.467/2017. Mais especificamente, concentra-se no objeto dos acordos e nos poderes exercidos pelo juiz no ato de sua homologação. Parte da premissa de que há limites jurídicos ao objeto dos acordos e busca defini-los. Analisa também os poderes de que o juiz dispõe, procurando identificar sua amplitude e propor parâmetros para o seu exercício. Inicia tratando das formas de solução dos conflitos e incursiona sobre os ditos métodos alternativos de resolução. Prossegue examinando a autocomposição extrajudicial nos conflitos individuais trabalhistas, colocando os principais problemas em torno de sua admissão, não sem antes fazer um breve resgate sobre o surgimento dessa espécie de disputa na história da humanidade. Apresenta notas sobre o tratamento da matéria em alguns ordenamentos jurídicos estrangeiros e sobre a evolução do tema no direito positivo brasileiro. Destaca a importância da participação estatal na autocomposição dos conflitos individuais trabalhistas. Estuda também a tradicional ideia de indisponibilidade dos direitos laborais, buscando distingui-la da ideia de inderrogabilidade, e propõe revisitar o seu conceito. Examina a natureza jurídica dos acordos individuais extrajudiciais trabalhistas previstos pela Lei n. 13.467/2017, identificando os seus elementos de existência, requisitos de validade e pressupostos de eficácia, e apresenta apontamentos sobre as suas principais causas de invalidade. Analisa a natureza da jurisdição voluntária e desenvolve seus principais atributos, estabelecendo também as premissas teóricas que permitem diferenciá-la da jurisdição contenciosa. Encerra-se com o exame dos poderes do juiz na atividade de homologação dos acordos individuais extrajudiciais trabalhistas, sobretudo no que diz respeito aos seus poderes decisórios, propondo elementos para aferir seu alcance e parâmetros para o seu exercício.

This research is dedicated to analyzing the out-of-court settlement agreements of individual labor disputes, according to the Law n. 13.467/2017. More specifically, it focuses on the object of the settlements and the judges powers in its approval. It admits that there are legal limits to the object of settlements and seeks to define them. The study also analyzes the judges powers, trying to identify their extent, and propose valuation parameters for their exercise. For that matter, the investigation begins studying the ways of settlement disputes and explores the so-called alternative disputes resolution. It goes on to examine out-of-court settlement agreements in individual labor disputes, placing the main problems surrounding its admission, not without first making a brief review of its emergence in human history. Some notes of the treatment of the subject in foreign law systems are presented and also its evolution in Brazilian law. The research highlights the importance of state participation in the settlement agreements of individual labor disputes and also studies the traditional idea of unavailability of labor rights, seeking to distinguish it from the idea of non-derogation, and proposes to revisit its concept. The legal nature of individual labor out-of-court settlement agreements provided for by Law n. 13.467/2017 is also considered, identifying its elements of existence, validity requirements and assumptions of effectiveness. The investigation goes on to present notes about its main causes of invalidity. The study also analyzes the nature of voluntary jurisdiction and outlines its main attributes, also establishing the theoretical premises that allow it to be distinguished from contentious jurisdiction. This research ends with an examination of the judge's powers in the approval of individual labor out-of-court settlement agreements, in particular with regard to their decision-making powers, proposing guidelines to assess their reach and the parameters for their exercise.
