A pesquisa versa sobre a participação das mulheres trabalhadoras na Assembleia Nacional Constituinte de 1987/1988, analisando a relação entre direito e gênero, com enfoque na divisão sexual do trabalho. Para tanto, a interseccionalidade, a decolonialidade e a amefricanidade são utilizadas como ferramentas teóricas para investigar o cotidiano e as demandas das mulheres, revisitando a história do direito, sobretudo o do trabalho, fora da perspectiva do sujeito universal. Os marcadores sociais de diferença (classe, gênero e raça) são considerados de forma imbricada com vistas a revelar lugares sociais reiteradamente preteridos, como o da mulher negra, para considerar sua força epistêmica. O direito se apresenta não só como instrumento de dominação entre classes, que são fortemente informadas pela raça, mas também entre sexos. A maior participação política de grupos dominados amplia o repertório discursivo e altera o conteúdo do direito, ainda que sob o controle do grupo que majoritariamente ocupa os espaços de poder. A conformação dos direitos sociais constitucionalizados demonstra este limite.

The research addresses the participation of working women in the 1987/1988 National Constituent Assembly, analysing the relationship between law and gender, with a focus on the sexual division of labour. For that, intersectionality, decoloniality and amefricanity are used as theoretical tools to investigate the daily life and demands of women, revisiting the history of law, especially that of labour, outside the perspective of the universal subject. The social markers of difference (class, gender and race) are considered in an interwoven way in order to reveal repeatedly neglected social places, such as that of the black woman, to consider their epistemic strength. The law presents itself not only as an instrument of domination between classes, which are strongly informed by race, but also between sexes. The greater political participation of dominated groups expands the discursive repertoire and changes the content of the law, even if under the control of the group that mainly occupies the spaces of power. The configuration of constitutionalized social rights demonstrates this limit.
