A reforma da previdência do servidor público é constantemente objeto da agenda política e econômica no Brasil. Atualmente não é diferente. Sob a justificativa de que o Regime Próprio de Previdência Social possui falhas estruturais e acarreta um déficit enorme nos cofres públicos, o governo vem estudando várias hipóteses de alteração das normas constitucionais que regem o sistema previdenciário dos servidores públicos. Tais alterações muitas vezes prejudicam os segurados, diminuindo direitos sociais ou mesmo quebrando expectativas dos servidores que já se planejavam se aposentar. Diante disso, o estudo acerca das mais importantes reformas da previdência, promovidas pelas Emendas Constitucionais nº 20/1998 e nº 41/2003, bem como a análise das decisões do Supremo Tribunal Federal sobre o tema são imprescindíveis para se entender qual o limite de atuação do Poder Constituinte derivado reformador nesta seara. Esses limites encontram-se na própria Constituição da República, entretanto, muito se discute a respeito do alcance da proteção constitucional, especialmente em relação às cláusulas pétreas. Buscou-se, assim, por meio das Teorias do Poder Constituinte e do núcleo essencial da Constituição, uma interpretação razoável do texto constitucional (art. 60, §4º), de modo a ser possível ao poder de reforma alterar normas que tratem de temas protegidos pelas cláusulas pétreas, permitindo que a Carta Política se adeque às novas realidades políticas, econômicas e sociais do país, desde que respeitem as matérias imprescindíveis à configuração das linhasmestras da Constituição da República.

The reform of the Public Service Pension System is constantly the subject of the political and economic agenda in Brazil. It's no different today. Under the justification that the Public Service Pension Scheme has structural failures and entails a huge deficit in the Treasury, the government has been studying various hypotheses of changes in the constitutional norms that rule the pension scheme for public servants. Such changes often harm public servants, downgrading social rights, or even breaking expectations of those who are already planning to retire. Therefore, the study of the most important social security reforms, promoted by Constitutional Amendments 20/1998 and 41/2003, as well as the analysis of the decisions of the Federal Supreme Court on the subject are essential to understand the limit of action of the Derived Constituent Power on this theme. These limits are found in the Constitution of the Brazilian Republic, however, much is discussed about the scope of constitutional protection, especially in relation to the amendments material limits. Thus, through the Theories of Constituent Power and the essential nucleus of the Constitution, a reasonable interpretation of the constitutional text (article 60, §4º) was sought, so that the power of reform could change norms that deal with themes protected by the material limits, in order to allow the Charter to adapt to the new political, economic and social realities of the country, provided that they respect the essential matters to the configuration of the master lines of the Constitution of the Brazilian Republic.
