Esta dissertação tem como objetivo discutir a hipersuficiencia trabalhista, nova categoria de empregados que surgiu com a Reforma Trabalhista de 2017 no Brasil, a partir do método marxista e a crítica da forma jurídica. Segundo essa matriz teórica, no capitalismo a força de trabalho se torna a mercadoria principal que se compra e vende no mercado, pois sendo comprada na circulação por seu equivalente, na produção é extraída sua mais valia, permitindo a valorização do capital. Neste sentido, o direito é uma forma social burguesa cuja função é regular as relações de troca. Sendo assim, frente a reestruturação produtiva do capital, a organização jurídica da força de trabalho sofre mutações para acompanhar e garantir as relações de produção. Portanto, a categoria da hipersuficiencia é um reflexo desse processo, aprofundando a subjetividade jurídica sem romper com a lógica do assalariamento e da exploração do trabalho.

This dissertation aims to discuss labor hypersufficiency, a new category of employees that emerged with the 2017 Labor Reform in Brazil, based on the Marxist method and the critique of the legal form. According to this theoretical matrix, in capitalism the work force is converted into the main commodity that is bought and sold in the market, and when it is bought in circulation for its equivalent, its surplus value is extracted in production, allowing the appreciation of the capital. In this sense, law is a bourgeois social form whose function is to regulate exchange relations. Therefore, before the productive restructuring of capital, the legal organization of the work force undergoes mutations to accompany and guarantee the production relations. Therefore, the category of hypersufficiency is a reflection of this process, deepening the legal subjectivity without breaking with the logic of wage and labor exploitation.
