Apesar de a Constituição Federal assegurar o direito de livre associação sindical aos servidores públicos civis e de o Brasil ser comprometido a fomentar a negociação coletiva de trabalho no âmbito da administração pública (ao menos desde a promulgação da Convenção nº 151 da OIT, em 2013), essa metodologia de tratamento de conflitos coletivos pouco tem se desenvolvido, registrando-se apenas experiências ainda isoladas ou descontinuadas de mesas de negociação e, em menor grau, de celebração de acordos com caráter normativo. A ausência de legislação de sustento dispondo sobre procedimentos negociais, sobre representação sindical e da administração pública nas mesas de negociação e sobre mecanismos de solução do conflito no caso de frustação das negociações é um dos fatores que interfere negativamente no desenvolvimento de relações de trabalho mais sadias no âmbito da administração pública. A mora legislativa quanto à regulamentação do direito de greve dos servidores de igual maneira gera dificuldades para a resolução dos conflitos de interesses, justamente no seu momento mais agudo. O não desenvolvimento de uma metodologia de composição de interesses contrapostos, compatível com o direito de livre sindicalização (autonomia coletiva) e de greve na forma da lei, frustra sua utilização como técnica de gerenciamento e gestão da prestação dos serviços públicos, cuja qualidade tem se deteriorado na percepção da sociedade, conforme indicam constantes manifestações populares. Com o propósito de identificar o conteúdo da argumentação jurídica prevalente, a tendência decisória dos tribunais e a repercussão da atual jurisprudência na efetivação da livre sindicalização dos servidores públicos, a presente pesquisa se dedicou ao estudo de decisões judiciais paradigmáticas, especialmente as emanadas do Supremo Tribunal Federal, que tiveram por objeto questões sindicais e conflitos coletivos emergentes da relação de trabalho entre servidores e administração pública. A conclusão a que se chegou foi a de que as decisões judiciais analisadas interpretaram o direito essencialmente a partir das categorias tradicionais da dogmática jurídica, segundo as quais a relação entre administração pública e servidores tem natureza de direito público e os conflitos a ela inerentes não comportam solução negociada, que tem fundamento na autonomia da vontade; a relação e os conflitos se submetem à unilateralidade do gestor e aos princípios que regem a relação do Estado com a sociedade, especialmente o da legalidade. Adotando essa linha de argumentação, as decisões atuam como estruturas que bloqueiam a efetivação do direito de livre sindicalização no que diz respeito à sua finalidade material (negociação coletiva de trabalho), emitindo sinais contrários a iniciativas legislativas ou administrativas de fomento à instituição da negociação coletiva, com força normativa, como metodologia de tratamento dos conflitos coletivos de trabalho no âmbito da administração pública. De outro lado, a eventual mudança na orientação jurisprudencial, ainda que seja apenas uma operação interna do sistema jurídico, criaria uma nova abertura cognitiva, estimulando variações no ambiente social.

Although the Brazilian Constitution protects the right of civil servants to unionize and although Brazil is committed to promoting collective bargaining at the government level (since the adoption of ILO Convention No. 151, 2013), a method for addressing collective labor disputes has not yet been developed, there being only a handful of isolated or discontinued collective bargaining experiences and, to a lesser extent, the agreements resulting from them have been marked by a normative nature. The absence of legislation on collective bargaining procedures, and on the representation of unions and the public administration at the negotiation table, in addition to the lack of legislation addressing dispute resolution mechanisms in case of failure to reach a bargaining are factors that negatively affect the development of healthier labor relations under the scope of the public administration. The delay of lawmakers in regulating the right to strike of civil servants also hampers the resolution of conflicts of interest, at labor relations' acutest moment. Failure to develop a methodology for solving disputes taking into account the right to unionize (collective autonomy) and the right to go on strike in the form of the law, frustrates its use as a management tool for providing public services, such services, in turn, have deteriorated in quality in the perception of society, as repeated protests have shown. In order to identify the content of the prevailing legal arguments concerning the issue, in addition to studying the decision-making trends of the courts, and the repercussion of the current case law in protecting public servants' right to unionize, this study focuses on paradigmatic judicial decisions, especially those issued by the Brazilian Supreme Court, addressing labor unions and collective disputes emerging from the labor relations between civil servants and the public administration. This study concludes by finding that the judicial decisions analyzed essentially construe the Law in the light of traditional categories of legal dogmatics, according to which the relationship between the public administration and its civil servants has a public law nature and the inherent disputes do not fall under the scope of collective bargaining, which, in turn, is based on freedom of will; therefore, the very relation and the disputes are submitted to the unilateral authority of the public administration and to the principles that govern the relation of the State and society, especially the legality principle. This study argues that by adopting this line of thought, court decisions operate as structures that block the realization of the right to unionize in terms of its material purpose (collective bargaining), thus working against legislative or administrative initiatives that encourage the application of collective bargaining, with normative force, as a method of addressing collective labor disputes within the public administration. On the other hand, any change in the orientation of current case law, despite representing a mere internal operation in the Brazilian legal system, could create new cognitive pathways, thus leading to a transformed social environment.
