A Lei 13.467/17, conhecida como Reforma Trabalhista alterou a estrutura da Consolidação das Leis Trabalhistas e modificou qualitativamente o Direito do Trabalho no sentido de uma tendência flexibilizadora dos direitos sociais. Este trabalho almeja oferecer ao pesquisador do direito uma explicação para os retrocessos estabelecidos nesta Lei, buscando seus fundamentos fora do ordenamento jurídico. É na história do Brasil contemporâneo, nos meandros da crise política, econômica, social e ambiental deflagrada no País nos últimos anos que buscamos as respostas para explicar a Lei 13.467/17. Começamos pelo breve resgate do contexto da crise econômica de 2008 e a onda de contrarreformas provocada por ela. Este trabalho analisa o período de 2015 até 2017 no Brasil, sistematizando a compreensão de vários autores sobre a economia, sobre a classe trabalhadora, a burguesia e as classes médias, o golpe institucional de 2016, as mobilizações reacionárias que tomaram as ruas do Brasil e os bastidores do congresso nacional no período. É nesta abordagem multidisciplinar que buscamos justificar nossa hipótese de trabalho: a Lei 13.467/17 é resultado de uma derrota da classe trabalhadora, provocada por fatores complexos que não suportam uma motivação unívoca, por isso a necessidade de abordar a realidade brasileira em tantas e diversas dimensões. Nossa abordagem não se resume a um pessimismo contemplativo, mas ao contrário, partimos do reconhecimento que o Direito do Trabalho está em movimento, se relaciona diretamente com as conquistas e retrocessos da classe trabalhadora e, portanto, compreender a derrota é um passo decisivo para superá-la.

Law 13.467/17, known as Labor Reform, changed the structure of the Consolidation of Labor Laws and qualitatively modified Labor Law in the direction of a trend towards the flexibilization of social rights. This work aims to provide the law researcher with an explanation for the setbacks established in this Law, seeking its foundations outside the legal system. It is in the history of contemporary Brazil, in the intricacies of the political, economic, social, and environmental crisis triggered in the country in recent years that we seek answers to explain Law 13.467/17. We start by briefly rescuing the context of the 2008 economic crisis and the wave of counter-reforms it caused. This work analyzes the period from 2015 to 2017 in Brazil, systematizing the understanding of various authors about the economy, the working class, the bourgeoisie and the middle classes, the institutional coup of 2016, the reactionary mobilizations that took to the streets of Brazil and the backstage of the national congress in the period. It is in this multidisciplinary approach that we seek to justify our working hypothesis: Law 13.467/17 is the result of a defeat of the working class, caused by complex factors that do not support a univocal motivation, hence the need to approach Brazilian reality in so many and diverse dimensions. Our approach is not limited to contemplative pessimism, but on the contrary, we start from the recognition that Labor Law is in motion, is directly related to the achievements and setbacks of the working class and therefore understanding the defeat is a decisive step to overcome it.
