Os poderes do juiz no primeiro grau de jurisdição e na fase de conhecimento constituem um tema clássico de estudo no direito processual, abordado por processualistas ao longo da história. As reformas processuais por vezes podem alterar a extensão dos poderes do juiz. A pesquisa almeja estudar os efeitos das reformas processuais nos poderes do juiz do trabalho. Partindo de premissas metodológicas instrumentalistas e publicistas, a presente dissertação investiga os fundamentos dos poderes do juiz no processo civil, navegando pela formação histórica e relação entre os institutos fundamentais e princípios do processo e a temática. Reconhecendo a autonomia do processo do trabalho, a dissertação constrói arcabouço próprio para a análise das reformas processuais trabalhistas, assentando escopos e principiologia próprios do processo trabalhista. O artigo 765 da CLT ("Consolidação das Leis do Trabalho"), norma-matriz dos poderes do juiz do trabalho, é considerado farol e amálgama equitativo do processo do trabalho, capturando o particularismo desigual dos conflitos trabalhistas individuais. Como farol, situase na antessala da integração normativa trabalhista, a permitir apenas o ingresso de normas estranhas que versem sobre os poderes do juiz do trabalho que tenham aptidão de concretizar escopos, principiologia e espírito equitativo do processo do trabalho. Já como amálgama, exterioriza o conteúdo equitativo do processo do trabalho para lidar com alterações da extensão dos poderes do juiz do trabalho advindas de mudanças internas no processo do trabalho. Lendo as reformas processuais a partir do exposto, a dissertação conclui que houve aumento dos poderes do juiz do trabalho após as reformas processuais. Ao final, aponta quadro crítico de intervenções de ofício do juiz do trabalho.

The power of the judge is one of the classical subjects researched by those interested on the Procedural law all through the times. The procedural legislative changes can decrease or increase the powers of the judges. This dissertation aims to study the procedural legislative changes regarding the labour judge powers. Considering the instrumentality and the publicism as premisses, this dissertation analyses the judge powers fundamentals, its historical evolution and the relationship between the procedural law fundamentals, its principles, and the judge powers. It recognizes the labour procedure autonomy and, therefore, their specific scopes and principles. The article 765 of the CLT ("Labour Rules Consolidation"), the foundation law to the labour judge powers, is considered both the equitable lighthouse and the amalgam of labour procedure as it absorbs the unequal individual labour litigation particularities. As an equitable lighthouse, the article 765 shows itself in the antechamber of the procedural labour law. It acts as gap-filling technique ("filter") that allows only the application of a judge power procedural civil rule if it can fulfil the specific scopes and principles of procedural labour law and its equitable content. As an amalgam, the article 765 portrays the equitable content of procedural labour law and acts as a paradigm to analyse the labour procedural legislative changes. Analysing the procedural legislative changes and considering the premisses, this dissertation concludes that there was an increase of labour court judge powers. It also summarizes the possibilities of labour court judge powers in the lower courts.
