A deflagração de greves sem comando do sindicato profissional, como reação à crise de representatividade enfrentada pelas entidades sindicais, evidencia o esgotamento do modelo sindical brasileiro, a sinalizar a necessidade de reformas na estrutura do sindicalismo nacional. O trabalho contribui para a reconstrução do sistema brasileiro de organização sindical, sugerindo alterações normativas profundas. Além disso, examina, com base no atual ordenamento jurídico, os limites e as possibilidades dos movimentos reivindicatórios dissidentes, no contexto da crise de representatividade sindical, adotando como premissa a larga amplitude constitucionalmente conferida ao direito fundamental de greve. Para tanto, as normas jurídicas atualmente vigentes no País são consideradas sob o prisma da concordância prática e dos métodos de interpretação sistemático e teleológico. Examina-se, ainda, a polêmica que envolve a possibilidade de negociação direta pelos trabalhadores, bem como a discussão quanto à responsabilização dos sindicatos por abusos cometidos em greves lideradas por dissidentes. Dispondo sobre teses antagônicas de diversos autores, dispositivos constitucionais e legais pertinentes, estudo de casos e recente posicionamento dos Tribunais, este trabalho apresenta reflexões, a fim de contribuir para a atualidade do tema, apontando elementos que direcionem doutrina, jurisprudência e eventuais alterações legislativas quanto à questão. Concluiu-se ser imprescindível a introdução de alterações normativas na organização sindical brasileira, para aproximar os sindicatos ao ideal democrático e, com isso, superar a crise de representatividade. Por outro lado, reconhecendo-se que a reestruturação sindical ainda se mostra distante da realidade brasileira, concluiu-se, dessa vez com base na atual sistemática jurídica brasileira sobre a matéria, ser imprescindível a releitura da restritiva e formalista Lei nº 7.783/1989, a partir da flexibilização prática da greve, a fim de não permitir que meros aspectos formais tornem-se óbice à realização do direito fundamental de greve.

The outbreak of strikes without command of the employees' unions, as a reaction to the crisis of trade union representativeness, exposes the exhaustion of the Brazilian union pattern, showing the necessity of reforms in the structure of national trade unionism. The present work contributes to the reconstruction of the Brazilian system of union organization, suggesting profound normative changes. In addition, this study examines, on the basis of the current legal system, the limits and possibilities of the dissident movements, in the context of the crisis of trade union representativeness, adopting as a premise the wide magnitude constitutionally granted to the fundamental right to strike. For this purpose, the current norms in Brazil are considered from the perspective of harmonization and methods of systematic and teleological interpretation. This dissertation also examines the controversy over the possibility of direct negotiation by workers, as well as the discussion about the accountability of trade unions for abuses committed in strikes that are led by dissidents. Dealing with antagonist theses of several authors, pertinent constitutional and legal dispositions, the study of cases and recent position of the Courts, this work presents reflections to contribute with this debate, indicating elements that guide doctrine, jurisprudence and possible legislative changes concerning the issue. The conclusion found is that the introduction of normative changes in the Brazilian system of union organization is indispensable, in order to bring trade unions closer to the democratic ideal and, with that, overcome the crisis of representativeness. On the other hand, recognizing that the union restructuring is still far from the Brazilian reality, it was concluded, this time based on the current Brazilian legal system on the subject, that is absolutely necessary the rereading of the restrictive and formalistic Law nº 7.783/1989, based on the practical flexibilization of the strike, in order not to permit that mere formal aspects become an obstacle to the realization of the fundamental right to strike.
