Partindo das contribuições de Pachukanis (2017) e Edelman (2016) sobre a crítica marxista do direito, busca-se entender a relação entre forma jurídica e trabalho reprodutivo, a fim de analisar de que maneira o direito também garante a manutenção das desigualdades de gênero, vez que o trabalho doméstico aparece à margem do contrato de trabalho (ORIONE; BIONDI, 2011). Para enfrentar a questão, parte-se da ideia de que há relações umbilicais entre direito, Estado, divisão por gênero do trabalho e modo de produção capitalista, teorizando produção e reprodução de maneira conexa, diante da Teoria Unitária da Reprodução Social. Com isso, entende-se que a contratualização e organização estatal do modelo familiar, bem como a divisão tipicamente capitalista entre público e privado, são basilares para a lógica da equivalência que, por sua vez, se relaciona com a venda da força de trabalho, com a circulação de mercadorias e com a acumulação de capital, ao passo que garante a reposição diária e geracional da força de trabalho em condições de exploração. A partir destas colocações, propõe-se que há atualizações no sujeito de direito no neoliberalismo diante da aceleração da realização do valor, do crescente exército de reserva e da responsabilização das mulheres pela reprodução da força de trabalho nestas condições.

Based on the contributions of Pachukanis (2017) and Edelman (2016) on the Marxist critique of law, we seek to understand the relationship between legal form and reproductive work, in order to analyze how the law also guarantees the maintenance of gender inequalities, since domestic work appears outside the employment contract (ORIONE; BIONDI, 2011). To address the issue, it starts from the idea that there are umbilical relationships between law, State, gender division of labor and capitalist mode of production, theorizing production and reproduction in a connected way, in view of the Unitary Theory of Social Reproduction. With this, it is understood that the contractualization and state organization of the family model, as well as the typically capitalist division between public and private are fundamental to the logic of equivalence which, in turn, is related to the sale of the workforce, with the circulation of goods and the accumulation of capital, while guaranteeing the daily and generational replacement of the workforce in conditions of exploitation. Based on these statements, it is proposed that there are updates on the subject of rights in neoliberalism in the face of the acceleration of the realization of value, the growing reserve army and the responsibility of women for the reproduction of the workforce under these conditions.
