A presente tese pretende estudar o intricado relacionamento entre o direito e as recentes greves por fora do sindicato, conhecidas doutrinariamente como "greves selvagens". Para tanto, busca uma caracterização fática, histórica e sociológica dessas greves, bem como sua significação política. Opera a análise a partir da crítica do direito, investigando as especificidades do tratamento conferido pelo sistema de controle judicial às greves por fora e identificando as tensões resultantes da relação entre o direito e esses fenômenos grevistas não sindicais.

The following thesis intends to study the intricated relationship between Law and the recent well-known wildcat strikes. Therefore, looks for a phatic, historical and sociological description of these kind of strikes, as well as its political significance. Then, operate an analysis from the Law criticism, investigating the specificities of the treatment provided by the judicial control system to wildcat strikes and identifying the tensions resulting from the that relation between Law and these non-syndical strikes phenomenon.
