O enrijecimento da legislação no combate à corrupção, fruto do contexto político nacional e internacional, provocou uma série de repercussões nas mais diversas áreas do direito. Nesse contexto, o estudo do fenômeno corruptivo não está dissociado das relações de trabalho. O presente trabalho busca identificar quais foram as repercussões que a Lei nº 12.846/13, conhecida como Lei Anticorrupção Empresarial, ocasionou para as relações entre empregado e empregador. Nesse intuito, serão analisadas três importantes marcos da Lei nº 12.846/13 à luz do direito do trabalho: (i) previsão da responsabilização objetiva da pessoa jurídica; (ii) programas de integridade como fator a ser levado em consideração no momento da aplicação da sanção; e (iii) incentivos à cooperação com o Poder Público no âmbito das investigações. Além disso, serão analisados aspectos do direito do trabalho que emergem no âmbito da implementação de um programa de integridade empresarial e condução de investigações internas para apuração de atos de corrupção.

The national and international political context contributed to the increase of legislation against corruption, which has caused repercussions in different practices of law. In this context, the analysis of corruption as a phenomenon cannot be dissociated from labor relations. This paper seeks to identify the repercussions of Law no. 12,846/13, known as the Clean Company Act, in the relationships between employee and employer. To this end, three important topics of Law no. 12.846/13 will be analyzed through the perspective of labor laws and relations: (i) provisions on strict liability applicable to legal entities; (ii) compliance programs as a factor to be taken into account to determine the measure of the sanction; and (iii) incentives to cooperate with Public Authorities within investigations. Furthermore, this paper will also analyze aspects of labor law that emerge at the time of implementing a compliance program and conducting internal investigations will also be analyzed.
