A presente tese se propôs a analisar o Direito Processual do Trabalho, dividido em fases, até culminar no Novo Processo do Trabalho, afinado com os paradigmas do CPC/2015 e da Constituição, e dotado das seguintes características: aglutinador e poroso, célere e simplificado procedimentalmente, flexível/plástico, efetivo, cooperativo e conectado com o direito material, especial com relação ao Processo Civil. É, portanto, receptivo ao traslado de normas exógenas à CLT, desde que observados os critérios delineados na tese. A pesquisa dedicou-se ao estudo do modelo cooperativo de processo, que promove a integração dos sujeitos processuais e do gerenciamento processual (case management) de forma compartilhada, com as incursões do direito estrangeiro, bem como a análise dos impactos desses institutos na seara trabalhista. Debruçou-se também sobre a aplicação dos negócios jurídicos processuais atípicos ao Processo do Trabalho, à luz de alguns dogmas do Direito Material e sua repercussão sob a ótica processual, definindo-se a compatibilidade do art. 190 do CPC com o ordenamento trabalhista e o regime jurídico aplicável. Não se pode excluir a aplicação sem antes verificar o caso concreto, a condição real das partes e o objeto negociado. Posteriormente, o foco se voltou ao modelo de flexibilização procedimental proposto pelo CPC/2015, com mudança do paradigma da rigidez do rito, prevista anteriormente. Fixaram-se as diretrizes para obtenção de um modelo mais adequado de processo, adaptado às peculiaridades do direito material e voltado à maior eficiência e efetividade da tutela. Utilizou-se a possibilidade de flexibilização/adaptação procedimental, ora exigindo maior atuação judicial (case management) ora demandando uma condução mais ativa das partes por meio dos negócios processuais, ou ainda, de forma compartilhada entre os sujeitos processuais. Propôs-se, para atingir ao objetivo colimado neste trabalho, a aplicação do art. 357 do CPC como instrumento para garantir um gerenciamento do processo eficiente, seja ele na forma compartilhada (art. 357, § 3o, do CPC), convencionada (§ 2o) ou judicial. A atividade de saneamento e organização do processo à luz do CPC de 2015 e do modelo cooperativo de processo estabelecido como um de seus alicerces consagra verdadeiro estágio de gestão processual, conduzido pelo juiz em conjunto com a participação ativa das partes (art. 357).

The present thesis analyzes the Labor Procedural Law, divided into phases, until culminating in the New Labor Procedural Law, in tune with the paradigms of CPC/2015 and the Constitution, and endowed with the following characteristics: unifying and porous, fast and simplified procedurally, flexible/plastic, effective, cooperative and connected with substantive law, especially in relation to Civil Procedure. It is, therefore, receptive to the transfer of exogenous norms to the CLT, provided that the criteria outlined in the thesis are observed. The research was developed to study the cooperative process model, which promotes the integration of procedural subjects and procedural management (case management) in a shared way, with the incursions of foreign law, as well as the analysis of the effects of these institutes in the labor field. It also focused on the application of atypical procedural legal transactions to the Labor Process, in the light of some substantive law dogmas and their repercussions from a procedural perspective. The compatibility of art. 190 of the CPC with the labor system and the applicable legal regime. Application cannot be excluded without first checking the concrete case, the real condition of the parties and the negotiated object. Subsequently, the focus turned to the model of procedural flexibility proposed by CPC/2015, with a change in the paradigm of rigidity of the rite, previously foreseen. It was established as guidelines to guarantee a more adequate model of process, adapted to the peculiarities of substantive law and treated with greater efficiency and followed by guardianship. The possibility of flexibility/procedural adaptation is used, sometimes motivating greater judicial action (case management) sometimes demanding a more active conduction of the parties through the procedural business, or even, in a shared way between the procedural subjects. It is proposed, in order to reach the objective collimated in this work, the application of art. 357 of the CPC as an instrument to ensure efficient management of the process, be it shared (art. 357, §3 of the CPC), agreed (§2) or judicial. The activity of reorganization and organization of the process in light of the CPC of 2015 and the cooperative model of the process established as one of its foundations, consecrated a true stage of procedural management, ensured by the judge together with the active participation of the parties (art. 357).
