O presente trabalho objetiva analisar as formas de interação entre o poder de fiscalização do empregador e a privacidade do empregado. Inicia-se com a definição dos conceitos de subordinação e privacidade, com a análise da formação dos conceitos nos Estados Unidos e no sistema supranacional europeu. Em seguida, prossegue-se com análise das situações de controle decorrentes de novas ferramentas de trabalho e as características que o conflito entre privacidade e o poder de fiscalização assumem.

The present work aims to analyze the forms of interaction between the power of supervision of the employer and the privacy of the employee. It begins with the definition of the concepts of subordination and privacy, with the analysis of the establishment of concepts in the United States and in the European supranational system. Next, we proceed with the analysis of the control situations arising from new work tools and the characteristics that the conflict between privacy and the power of supervision assume.
