Esta tese trata da aplicação dos Punitive Damages como instrumento de concretização da igualdade e da dignidade do trabalhador, por meio da promoção de um Meio Ambiente do Trabalho Saudável e Seguro. Tem como objetivo investigar se o caráter punitivo-pedagógico é aplicável no ordenamento jurídico brasileiro e se é capaz de desestimular atos negligentes do empregador sobre os riscos existentes no Meio Ambiente do Trabalho. Para isso, a tese foi estruturada em quatro capítulos: o primeiro investiga o fundamento moral dos punitive damages; o segundo analisa as teorias da Análise Econômica do Direito e do Liberalismo Igualitário e compara-as às nossas práticas e nossos ideais de proteção ao trabalhador; o terceiro analisa se o caráter punitivo-pedagógico, quando aplicado às indenizações por danos extrapatrimoniais, é adequado às práticas jurídicas brasileiras; e o quarto avalia se a negligência é o principal fator causador dos acidentes do trabalho no Brasil. O estudo demonstrou que condutas negligentes dos empregadores são práticas comuns no Brasil e não respeitam a dignidade do trabalhador. A indenização por danos extrapatrimoniais, quando dotada de caráter punitivo-pedagógico, pode ser um elemento de desestímulo dessas práticas e de tratamento mais igualitário e digno ao trabalhador.

This thesis focus on the application of Punitive Damages as an instrument for achieving equality and dignity of the worker, through the promotion of a Healthy and Safe Work Environment. It intends to investigate whether the punitivepedagogical character is applicable in the Brazilian legal system and if it is capable of deterring negligent acts of the employer upon the risks existing in the Work Environment. To this end, the thesis was structured in four chapters: the first one investigates the moral foundations of punitive damages; the second one analyzes theories of Economic Analysis of Law and Liberal Egalitarianism and compares both of them to our practices and our ideals about worker protection; the third one examines whether the punitive-pedagogical character, when applied to indemnizations for moral damages, is adequate to Brazilian legal practices; and the fourth one evaluates whether negligence is the main cause of labor accidents in Brazil. The study proved that negligent behaviors of employers are common practices in Brazil and do not respect the dignity of the worker. Indemnization for moral damages, when invested with a punitive-pedagogical character, can be an element of deterrence of those practices and of a more egalitarian and dignified treatment to the worker.
