A presente tese estuda o instituto da prescrição em pretensões coletivas na Justiça do Trabalho, a incidência do prazo prescricional sobre essas pretensões coletivas e os efeitos desse prazo nas demandas coletivas e individuais. Há uma lacuna normativa quanto ao prazo da prescrição quando se trata de pretensões coletivas. O Tribunal Superior do Trabalho inclinou-se para a adoção do prazo quinquenal previsto na lei da ação popular, a despeito das teses sobre a imprescritibilidade dos direitos metaindividuais. A temática é importante porque envolve o acesso coletivo à Justiça, as lesões em massa praticadas contra os trabalhadores e a harmonia do ordenamento jurídico pátrio no trinômio: reeducação social, reparabilidade das lesões e pacificação dos conflitos. Parte-se da premissa de que o objeto do direito metaindividual é coletivo e merece um tratamento adequado, distinto do aplicável ao direito individual. Foram analisados cinco ordenamentos para a regulamentação da prescrição individual trabalhista e do acesso coletivo à Justiça (Alemanha, Colômbia, Estados Unidos da América, França e Itália). Apresentaram-se criticamente as possibilidades normativas já desenvolvidas quanto ao prazo prescricional para as pretensões coletivas. A partir dessa premissa, foram desenvolvidos os resultados para a relação entre as demandas individuais e coletivas, aplicando-se as regras de impedimento, suspensão e interrupção dos prazos como proposta de harmonização de todo o sistema jurídico.

This thesis studies the institute of staatute of limitation in collective claims in the Labor Court, the incidence of the statute of limitations on these collective claims and the effects of this period in collective and individual claims. There is a regulatory gap regarding the statute of limitations when it comes to collective claims. The Superior Labor Court favored the adoption of the five-year period provided for in the popular action law, despite the theses regarding the imprescriptibility of meta-individual rights. The theme is important because it involves collective access to justice, mass injuries committed against workers and the harmony of the national legal system in the trinomial social re-education, reparation of injuries and pacification of conflicts. It starts from the premise that the object of metaindividual law is collective and deserves adequate treatment, distinct from that applicable to individual law. Five orders were analyzed regarding the regulation of individual labor prescription and collective access to justice (Germany, Colombia, United States of America, France and Italy). The normative possibilities already developed regarding the statute of limitations for collective claims were critically presented. Based on this premise, the results for the relationship between individual and collective demands were developed, applying the rules of impediment, suspension and interruption of deadlines as a proposal for the harmonization of the entire law system.
