Sob as lentes do direito do trabalho e direito processual do trabalho, pretende-se situar o debate acerca da proteção legal destinada à empregada gestante. O foco da análise são reflexões críticas sobre a estabilidade provisória prevista no artigo 10, b, II, da ADCT da Constituição Federal e suas repercussões. Mais especificamente, a pesquisa englobará o estudo de institutos, normas e princípios de direito interno, comunitário e internacional do trabalho quanto à proteção destinada ao labor de empregadas que engravidam durante o pacto laboral e o aviso prévio, dando enfoque à garantia ao emprego por meio do trabalho, proteção ao nascituro e também concessão de indenizações compensatórias. O objetivo desta investigação é identificar em que patamar normativo e jurisprudencial encontra-se a proteção ao trabalho da empregada gestante no Brasil, identificando pontos centrais para aperfeiçoamento do sistema e propor caminhos para eficácia desse direito fundamental.

Under the light of the labor law and the procedural labor law, the investigation intends to establish a massive discussion regarding the legal protection directed to the pregnant employee. The focus of this study are the critical considerations on the temporary stability predicted in the article 10, b, II, of the Transitory Constitutional Dispositions Act of the Federal Constitution and its repercussions. More specifically, the research will encompass the study of the institutes, norms and principles of internal law, communitary and international law regarding the protection destined to the job of employees that get pregnant during the labor relation and the notice of termination. The aim of this research is to identify in which normative level it is possible to verify the protection to the labor of the pregnant employee in Brazil, in order to analyze the main aspects for development of the system and to propose ways for the effectiveness of this fundamental right.
