A presente dissertação versa sobre estudo e análise prática dos danos extrapatrimoniais oriundos das relações de trabalho, em especial com alterações provenientes da Lei nº 13.467/2017. Inicialmente a pesquisa busca sistematizar a responsabilidade civil, máxime no que diz respeito aos deveres e direitos personalíssimos do empregado, considerando em si mesmo ou inserido em meio ambiente laboral, para estruturar ordem de danos extrapatrimoniais (moral, existencial, estético, socioambiental e moral coletivo). Um dos enfoques para este estudo é uma proposta de releitura construtiva e interpretativa sistemática dos artigos 223-A a 223-G da Consolidação das Leis do Trabalho. Para esta finalidade são abordados também aspectos de direito estrangeiro, tanto pela doutrina quanto jurisprudência, de países como Estados Unidos, Reino Unido, França, Espanha e Portugal desenhando modelos de quantificação e fixação de indenizações, com análise dos seus aspectos compensatórios, punitivos, pedagógicos e preventivos, demonstrando a inconstitucionalidade e inefetividade da utilização do sistema e tarifação das indenizações, em contraposição ao disposto no artigo 223-G da Consolidação das Leis do Trabalho.

This dissertation deals with the study and practical analysis of non-pecuniary damages arising from employment relationships, in particular from the changes that resulted to the Law nº 13.467/2017. Initially, the research seeks to systematize civil liability, maximum with regard to the employee's very personal duties and rights, considering himself or herself in the work environment, to structure an non-pecuniary damages system (moral, existential, aesthetic, socioenvironmental and collective morality). One of the focuses for this study is a proposal for a systematic and constructive reinterpretation of articles 223-A to 223-G of the Consolidation of Labor Laws. For this purpose, aspects of foreign law are also addressed, both by doctrine and jurisprudence, from countries such as the United States, United Kingdom, France, Spain and Portugal designing models for quantifying and fixing quantum for damages, with analysis of the following aspects: compensatory, punitive, pedagogical and preventive, demonstrating the unconstitutionality and ineffectiveness of the use of the system and the charging of indemnities, in contrast to the provisions of article 223-G of the Consolidation of Labor Laws.
