A formação de precedentes judiciais e sua relação com o devido processo legal, princípio maior do direito processual constitucional, são analisados no presente estudo. O tema surgiu em razão das dúvidas e dos problemas ocasionados quando da aplicação prática dos precedentes judiciais brasileiros inspirados na common law norte-americana. Percebe-se uma contradição entre os diversos institutos da common law adotados nas normas constitucionais brasileiras e as demais normas processuais civis infraconstitucionais de origem na civil law, a qual foi ampliada com a criação do sistema de precedentes judiciais qualificados no atual Código de Processo Civil. O objetivo do trabalho visa compreender a origem e interpretar as normas existentes, demonstrando a existência de princípios gerais e de princípios implícitos para os precedentes judiciais qualificados especialmente ligados à tutela coletiva de direitos. Além disso, permite identificar a existência de fases comuns no rito de formação do precedente judicial qualificado decorrente de decisões em regime de demandas repetitivas, assim como as diferenças entre o rito de formação de precedentes judiciais qualificados decorrentes dos recursos excepcionais (extraordinário e especial) repetitivos e o de formação de precedentes judiciais qualificados decorrentes de incidentes (IRDR, IAC e IAI). Dessa forma, pode-se preencher as eventuais lacunas legais quando da aplicação de um precedente judicial qualificado, por exemplo. Conclui pela existência de um arcabouço normativo comum, suplementado pelas normas dos Regimentos Internos dos Tribunais Superiores, em especial do Superior Tribunal de Justiça, salientando-se o papel fundamental que os participantes do processo - advogados e magistrados - têm na formação do precedente judicial qualificado.

The formation of judicial precedents and its relationship with due process of law, a major principle of constitutional procedural law, are analyzed in the present study. The theme arose due to the doubts and problems caused by the practical application of Brazilian judicial precedents - inspired by the North American common law. There is a contradiction between the various common law institutes adopted in the Brazilian constitutional norms and the other infraconstitutional civil procedural norms of origin in civil law, which was expanded with the creation of the system of judicial precedents qualified in the current Civil Procedure Code. The objective of the work is to understand the origin and interpret the existing norms, demonstrating the existence of general principles and implicit principles for qualified judicial precedents especially related to the collective protection of rights. In addition, it allows to identify the existence of common phases in the rite of formation of the qualified judicial precedent resulting from decisions in a regime of repetitive demands, as well as the differences between the rite of formation of qualified judicial precedents resulting from exceptional (extraordinary and special) repetitive appeals. and the formation of qualified judicial precedents arising from incidents (IRDR, IAC and IAI). In this way, any legal gaps can be filled when applying a qualified judicial precedent, for example. It concludes by the existence of a common normative framework, supplemented by the rules of the Internal Regulations of the Superior Courts, especially the Superior Court of Justice, emphasizing the fundamental role that the participants of the process - lawyers and magistrates - have in the formation of the qualified judicial precedent.
